A RESOLUTION OF THE COUNCIL OF THE CITY OF ALAMEDA
EXPRESSING OPPOSITION TO AR 187 AND SB 778 RELATING
TO COMPULSORY AND BINDING ARBITRATION
WHEREAS, AB 187 (Young) AND SB 778 (Stills) would enact
a system of compulsory and binding arbitration to settle collective
bargaining disputes with police officers; and
WHEREAS, binding arbitration has been proposed before
but this year the chance of passage has significantly improved;
and
WHEREAS, the newly elected governor has publicly stated
his support of this law enforcement issue and the organizations
representing the police officers in Sacramento have made compulsory
binding arbitration their number one legislative priority for
1933; and
WHEREAS, binding arbitration represents a fundamental
change in the negotiation process which would remove the final
decision -making authority from the City Council by introducing
an arbitrator as the final authority whose decision would be
final and binding; and
WHEREAS, by taking final decision-making powers and
authority from the Council and giving it to an outside third
Party in all areas of differences at the bargaining table, these
bills would give the arbitrator total discretion to decide on
a settlement with the cost totally paid by the City; and
WHEREAS, the proposed compulsory and binding arbitration
would cause great havoc in this City because the economic burden
of an arbitrator's decision would be paid for by local taxpayers;
and
WHEREAS, an arbitrator's decision would take away the
accountability of the local decision makers, who would no longer
have the power to make the final spending decisions, thus substan
tially increasing the probable cost to the City; and
WHEREAS, these bills would introduce a solution where
no problem exists, since negotiations with the Alameda Police
Association have progresssed routinely to a negotiated settlement
with good-faith meetings taking place between representatives
of the Association and the City;
NOW, THEREFORE, BE IT RESOLVED that the City of Alameda
expresses its strong opposition to AB 187 and SB 778, which
would destroy any City control over the bargaining process and
place what are rightfully local matters in the hands of an outside
third party; and
BE IT FURTHER RESOLVED that the Mayor is requested to
send this resolution, along with appropriate information, to
all other Alameda County cities, newspapers, and chambers of
commerce, and that the Mayor make direct inquiries to State
Legislators to determine their position on these pieces of
legislation.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meting assembled on the 5th day of April, 1983,
by the following vote to wit:
AYES: Counciltembers Diament, Sherratt, Stone and. President Corica - 4.
NOES: None.
