AUTHORIZING EXECUTION OF AN AGREEMENT FOR SERVICES
BY JOHN H. HEINDEL: CONSULTING ENGINEER, FOR
FORMATION OF A LANDSCAPE MAINTENANCE DISTRICT
WHEREAS, the City of Alameda has decided to form a
Landscape Maintenance District as provided by the Landscape and
Lighting Act of 1972; and
WHEREAS, said law requires that upon initiating said
District an Engineer's Report must be submitted to the County
Surveyor and to the City; and
WHEREAS, John H. Heindel, a Consulting Civil Engineer,
has had experience in undertaking Reports for the formation of
a Landscape Maintenance District;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the proposal of John H. Heindel, Consulting Civil
Engineer, dated October 5, 1983 and designated Job No. 8313,
a copy of which is attached, for engineering services in connec-
tion with the formation of a Landscape Maintenance District,
in an amount not to exceed $5,700, is hereby accepted; and
BE IT FURTHER RESOLVED that said proposal and this
acceptance shall constitute the agreement of the parties hereto.

As you requested, l am very pleased—to submit this proposal,
for providing services relative to the City of Alameda's
planned assessment district under the Landscaping and Light-
ing Act of 1972. I understand this district will include
all parcels fronting on Lincoln Avenue between St. Charles
Street and Sherman Street, on Webster Street between Central
Avenue and Lincoln Avenue, and, possibly, on Webster Street
between Lincoln Avenue and Atlantic Avenue.
Scope of Services
I propose to provide the following services relative to
this project:
1. Review available data which may have a bearing on the
benefits to be received by the various parcels within
the boundaries of the planned district.
2. Recommend one or more formulas for the distribution
of costs to the various-parcels.
3. Upon tentative approval of a formula by City staff and

City's legal counsel, compile a file of -.all data re-
quired for the selected formula, for each parcel to
be assessed.
. Using estimated cost information for the 1984 -85 tax
year, provided by the City, make a preliminary ; com-
puter spread of costs to the various parcels.
After review by City Staff and City's legal counsel
respread,as necessary to incorporate any revisions
to the formula or to the cost estimate.
Produce the Assessment roll to be incorporated in the
Engineer's Report.
Prepare,the diagram of the district, incorporating the
plans and specifications for the improvements and'in-
dicating any zones within the district.
Prepare the Engineer's Report, including all additional
items required by the Act of '1972.
Determine the percentage of protest filed relative to
the planned district.
10. Consult with City staff, City's legal counsels and
others as required, relative to the above services.
11. Attend any informational meetings -and public hearings
that might be held relative to these proceedings, to
explain the method of spreading assessments and to
answer any questions relative to`the above services.
12. Perform noticing services as requested, including pro-
ducing individual notices, producing address fables,
folding, stuffing, applying postage and mailing.
Fee for Services
1 propose to perform Items 1 through 11 above for a fee of
$5,700.00, assuming the parcels on Webster Street between
Lincoln Avenue And Atlantic Avenue are included in the disc

trict. If these parcels are bmited, this fee would be re-
duced by 3600.00.
I will submit a fee proposal for Item 12 above upon speci-
fication of the precise scope of services required.
I will perform any additional services, requested by the
City but not included. above, for a fee equal to S50.00 per
hour expended by me, plus 110% of the actual cost of any
required outside services or, expenses.
