APPROVING AND AUTHORIZING EXECUTION OF AMENDMENT TO
JOINT POWERS AGREEMENT WITH THE COUNTY OF ALAMEDA AND
VARIOUS CITIES WITHIN THE COUNTY RELATING TO THE
PLANNING, DEVELOPMENT AND ADMINISTRATION OF PROGRAMS
BY ALAMEDA COUNTY TRAINING AND EMPLOYMENT BOARD/
ASSOCIATED COMMUNITY ACTION PROGRAM
WHEREAS, an amendment has been proposed to the Joint Powers
Agreement dated April 22, 1975, creating the Alameda County Training
and Education Board and the Joint Powers Agreement dated May 2,
1974, creating the Associated Community Action Program; and
WHEREAS, the City of Alameda has participated in, with
full voting rights, the Alameda County Training and Employment
Board ("ACTEB") since its inception but was not a signatory
thereto, and is a party to the Associated Community Action
Program ("ACAP') Joint Powers Agreement; and
WHEREAS, the County and the cities participating in the
Joint Powers Agreement are desirous of combining for pro forma
purposes the separate ACTEB Joint Powers Agreement and the Separate
ACAP Joint Powers Agreement into one document; and
WHEREAS, the City of Berkeley has indicated its interest
and desire to become a member of the ACTEB Joint Powers Agency
necessitating modifications to the Agreement; and
WHEREAS, the proposed Amendment to Joint Powers Agreement
between the County of Alameda and the Cities of Alameda, Albany,
Berkeley, Dublin, Emeryville, Fremont, Hayward, Livermore, Newark,
Piedmont, Pleasanton, San Leandro and Union City has been submitted
to this Council and the Council is fully informed and aware of
the terms and conditions thereof; and
WHEREAS, it is in the best interests of the City of Alameda
that said amendment to agreement be entered into;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the Mayor and City Clerk be, and each hereby is,
authorized and directed to execute and to attest to, respectively,
on behalf of the City, that certain proposed Amendment to Joint
Powers Agreement between the County of Alameda and the cities
designated therein, to continue the separate public entities of
ACTEB and ACAP for the planning, development, and administration
of programs under and in accordance with the Job Training Partnership
Act and Community Services Block Grant and the State of California
enabling legislation, said amendment to be substantially in the
form of that on file in the office of the City Clerk.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st of August, 1984,
by the following vote to wit:
AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
