AUTHORIZING EXECUTION OF AGREEMENT WITH UNITED CABLE
TELEVISION OF ALAMEDA IN CONNECTION WITH FRANCHISE
AMENDMENT
WHEREAS, on July 22, 1984 this Council imposed an assess-
ment against United Cable Television of Alameda alleging that
United failed to timely complete construction of a cable system
in the City of Alameda as required by the terms of a Franchise
Agreement; and
WHEREAS, on December 29, 1984, the Cable Communications
Policy Act of 1984 became effective which limits the power of
franchising authorities to require payment of certain fees and
financial commitments by cable operators and raises permissible
franchise fees which may be imposed on gross revenues; and
WHEREAS, the City and United desire to resolve all dif-
ferences regarding said Assessment and said Act to provide for
the deferment and elimination of certain capital expenditures
and to provide for an increase in the franchisc fee; and
WHEREAS, an Agreement in Connection with Franchise Amend-
ment has been submitted to this Council and the Council is fully
informed and aware of the terms and conditions thereof; and
WHEREAS, it is in the best interests of the City of
Alameda that said agreement be entered into;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the Mayor of the City of Alameda is hereby
authorized and directed to execute, for and on behalf of the
City, that certain Agreement in Connection with Franchise Amend-
ment referred to above and the City Clerk is authorized to attest
to same.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 5th of February, 1985,
by the following vote to wit:
AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
