ORDERING VACATION OF CERTAIN UNUSED PUBLIC UTILITY
EASEMENT WITHIN LOT B OF TRACT 5218 (BRITTANY
LANDING, HARBOR BAY ISLE)
BE IT RESOLVED by the Council of the City of Alameda
that the certain Public Utility Easement located within Tract
5218, and described as:
All that REAL PROPERTY situate in the City of Alameda,
County of Alameda, State of California, described as
follows:
Being A PORTION of the existing 5 foot wide P.U.E. as
shown on Lot 8 of Tract 5218, recorded August 8, 1984,
in Book 147 of Maps, at pages 34 and 35, more particu-
larly described as follows:
BEGINNING at a point on the northerly line of said Lot
8, said point being at the easterly terminus of the course
described as N 88° 56' 24" W 59.00 feet, said point being
on the southerly line of Palm Beach Lane; thence leaving
said southerly line of Palm Beach Lane S 1 03' 36" W.
3.00 feet to the True Point of Beginning of the herein
described 2 foot wide strip; thence continuing southerly
S 1° 03' 36" W 2.00 feet to the beginning of a curve
concave to the southwest having a radius of 24.00 feet;
thence easterly 10.68 feet along said curve through a
central angle of 25° 30' 24" to the beginning of a non-
tangent curve cancave to the Northeast having a radius
of 10.00 feet and to which point a radial line bears
N 89° 00' 44" W; thence southeasterly 8.63 feet along
said curve through a central angle of 49° 25' 27"; thence
on a radial line N 41° 33' 50" E 2.00 feet to the begin-
ning of a curve concave to the Northeast having a radius
of 8.00 feet; thence northwesterly 8.08 feet along said
curve through a central angle of 57° 53' 30" to the
beginning of a non-tangent curve concave to the Southwest
having a radius of 26.00 feet and to which point a radial
line bears N 29° 35' 46" E; thence westerly 12.95 feet
along said curve through a central angle of 28° 32' 10"
to the True Point of Beginning. Containing 40 sq. ft.,
more or less.,
is hereby ordered vacated pursuant to the provisions of Chapter
4, Part 3, Division 9 of the California Streets and Highways
Code, and particularly Section 8333 thereof
BE IT FURTHER RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the said easement
ordered vacated herein is unnecessary for present or prospective
public use, and (2) said easement has never been used by the
City of Alameda for any purpose whatever since the date of its
acquisition to the date of this resolution.
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this order, attested under seal, to be recorded
in the County Recorder's Office and from and after the date
this resolution is recorded the public utility easement vacated
\no longer shall constitute a public utility easement.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 4th of June, 1985,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
