A RESOLUTION CONFIRMING APPORTIONMENT
OF ASSESSMENTS AND DIRECTING
CERTAIN ACTIONS WITH RESPECT THERETO
HARBOR BAY BUSINESS PARK ASSESSMENT DISTRICT 84 -4
RESOLVED, by the City Council of the City of Alameda, Alameda County,
California, that:
WHEREAS, in proceedings conducted pursuant to Resolution of Intention
No. 10498, adopted by this Council on December 18, 1984, assessments were
confirmed and levied upon the lots, pieces and parcels of land within Harbor
Bay Business Park Assessment District 84 -4, and bonds were issued to represent
unpaid assessments upon the land within said district;
WHEREAS, the subsequent thereto, the Director of Public Works of this
City as the Superintendent of Streets has received an application executed by
all persons owning an interest in an original lot or parcel of land within
said district, which application;
1. States that said lot or parcel has been subdivided or that the
ownership of a portion thereof has been transferred to a person other than the
original owner thereof;
2. Indicates in Exhibit "A" attached hereto and hereby made a ,
part hereof, how the original lot or parcel has been divided or transferred;
3. Requests that the Superintendent of Streets apportion the
amount remaining unpaid on the assessment in accordance with Exhibit "A" and
Division 10 of the Streets and Highways Code of the State of California; that
the Superintendent of Streets give notice of to the original bond purchaser in
accordance with Section 8740.3 of said Code; and that said Superintendent of
Streets amend the recorded diagram and assessment to conform to such division
and apportionment and assign new assessment numbers to each separate part of
the original lot or parcel when said Superintendent is satisfied that the
application is signed by all necessary persons and that no request for hearing
pursuant to said Section 8740.3 has been received; and
4. Is accompanied by fees prescribed by this City for the
accomplishment of the foregoing; and
WHEREAS, as of the date hereof, unpaid assessments against which bonds
have been issued remain upon each parcel thus divided or transferred;
NOW THEREFORE, IT IS ORDERED as follows:
1. The Superintendent of Streets has duly notified the original
purchaser of the bonds issued in said proceedings of the apportionment of
assessment in accordance with Section 8740.3 of the Streets and Highways Code
and no request for hearing has been received from said purchaser within 14
days of the date of mailing of such notice.
2. The apportionment of the assessments pursuant to said application
on file with the Superintendent of Streets and as set forth in Exhibit "A"
hereto, is hereby approved.
3. Said Superintendent of Streets is hereby authorized and directed to
cause to be amended the recorded assessment diagram and assessment to conform
to the aforesaid and approved apportionment and to cause to be assigned new
assessment numbers to each separate part of the original lot or parcel.
4. Said Superintendent of Streets shall cause the assessment roll on
file in his office to be corrected to conform to said apportionment and to be
prepared and recorded an amended assessment diagram in accordance with the
applicable provisions of said Division 10 of said Code.
5. Said Superintendent of Streets shall further cause to be prepared
an amended auditor's record reflecting said apportionment of assessment and
cause said record as amended to be transmitted to the Auditor of the County of
Alameda who shall be henceforth collect the installments due in accordance
with said amended record.
6. A certified copy hereof shall be provided by the City Clerk to said
Superintendent of Streets and to the County Auditor.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly adopted and passed by the Council of the City of Alameda in
regular meeting assembled on the 4th of June , 1985, by the
following vote to wit:
