DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY
REQUIRE FORECLOSURE OF THE LIENS OF CERTAIN
DELINQUENT UNPAID ASSESSMENT INSTALLMENTS AND
DIRECTING THE FILING OF FORECLOSURE ACTIONS IN THE
SUPERIOR COURT PURSUANT TO SECTIONS 8830 THROUGH
8835, INCLUSIVE, OF THE STREETS AND HIGHWAYS CODE
WHEREAS, in various proceedings heretofore undertaken by
this Council pursuant to assessment and assessment bond acts for
the acquisition and construction of public improvements, special
assessments have been levied upon land within the various
assessment districts formed in such proceedings, and bonds have
been sold to represent all of such special assessments which were
not paid in full within the statutory period allowed for cash
payments upon such assessments; and
WHEREAS, there now exists a substantial amount of
delinquencies in payment of the annual installments upon such
unpaid assessments which have become due and payable prior to the
date of adoption of this Resolution; and
WHEREAS, the public interest and necessity require that
appropriate action be taken to remedy such delinquencies,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that IT IS DETERMINED AND ORDERED as follows:
1. That an action or actions be brought in the Superior
Court, pursuant to and as authorized by Sections 8830 through
8835, inclusive, of the Streets and Highways Code of the State of
California, to foreclose the liens of the delinquent unpaid
assessment installments upon the parcel of land with respect to
fiscal year 1984-85, and as to said parcel said action or actions
include foreclosure of the liens of all delinquent unpaid
assessments thereon.
2. That the Law Firm of Michael R. Nave be and it is
hereby authorized and directed to institute and conduct to
conclusion actions to foreclose the liens of said delinquent
unpaid assessment installments and to take such actions as is
necessary therein.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 20th day of August, 1985,
by the following vote to wit:

NOES: None.
