CITY OF ALAMEDA RESOLUTION NO. 10724
CLARIFYING POLICING RESPONSIBILITIES ON SOUTH
SHORE BEACH AND ROBERT CROWN MEMORIAL STATE PARK
WHEREAS, the area within the City of Alameda known as
South Shore Beach and Robert Crown Memorial State Park is leased
to the East Bay Regional Park District; and
WHEREAS, the District is authorized to employ a Police
Department and the Beach and State Park is a concurrent police
jurisdiction between the City and the District; and
WHEREAS, the City has primary police jurisdiction, a
statute defining primary jurisdiction does not exist and the
legal basis for it is established from interpretation of the
State Constitution, other subordinate legal documents, codes,
court decision and legal opinion; and
WHEREAS, in the interest of effective, efficient, and
consistent police service it is important and necessary to
clarify police agency responsibilities;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that said City has primary police jurisdiction
and will provide police service on South Shore Beach and Robert
Crown Memorial State Park on a level consistent with problems
encountered and demand for service.
BE IT FURTHER RESOLVED that complete details of the
Police Service Plan are contained in Alameda Police Department
General Order No. 85-02, T-6, Titled Police Services - South
Shore Beach and Robert Crown Memorial State Park, which is
hereby incorporated in this Council resolution; and
o
BE IT FURTHER RESOLVED that the District is encouraged to
provide police service over and above that provided by the City,
particularly the enforcement of District rules, regulations and
ordinances.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd of September, 1985,
by the following vote to wit:
AYES: Councilmembers, Corica, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
