Resolution 10733CITY OF ALAMEDA RESOLUTION NO. 10733 ORDERING VACATION OF VARIOUS PUBLIC ROADWAY, PATHWAY AND STREET LIGHT EASEMENTS DUE TO REALIGNMENT OF HARBOR BAY PARKWAY WHEREAS, due to the realignment of Harbor Bay Parkway it is necessary to vacate various public roadway, pathway and street light easements; and WHEREAS, those easements designated below as Nos. 1, 2 and 3 have been replaced by easements dedicated to the City on that certain map entitled "Parcel Map No. 4497" filed January 24, 1985; and WHEREAS, those easements designated below as Nos. 4 and 5 will be replaced by easements dedicated to the City by separate instruments; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that the following easements are hereby ordered vacated pursuant to the provisions of Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8333 thereof: 1. A portion of Harbor Bay Parkway within Parcel 4, Parcel Map No. 4237, Alameda, California, recorded on October 21, 1983, and as set out in Exhibit "A" attached hereto and made a part hereof for legal description. 2. A public roadway easement within Parcel 1, Parcel Map No. 4238, Alameda, California, recorded on August 7, 1984, and as set out in Exhibit "B" attached hereto and made a part hereof for legal description. 3. A public right of way within Parcel 1, Parcel Map No. 3964, Alameda, California, recorded on August 7, 1984, and as set out in Exhibit "C" attached hereto and made a part hereof for legal description. 4. A pathway easement within Parcel 1, Parcel Map No. 3964, Alameda, California, granted to the City on March 30, 1983 and referenced on that certain map entitled "Parcel Map No. 3964 ", and as set out in Exhibit "D" attached hereto and made a part hereof for legal description. 5. A street light easement within Parcel 1, Parcel Map No. 3964, Alameda, California, granted to the City on March 30, 1983 and referenced on that certain map entitled "Parcel Map No. 3964 ", and as set out in Exhibit "E" attached hereto and made a part hereof for legal description. BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (1) the said easements ordered vacated herein are unnecessary for present or prospective public use, and (2) that said easements have never been used by the City of Alameda for any purpose whatever since the date of their acquisition to the date of this resolution. BE IT FURTHER RESOLVED that the City Clerk shall cause certified copies of this order, attested under seal, to be recorded in the County Recorder's Office and from and after the date this resolution is recorded the public service easements vacated no longer shall constitute public service easements.
