ORDERING VACATION_ OF PUBLIC UTILITY EASEMENT
LOCATED WITHIN TRACT 1866 (SOUTH SHORE CENTER)
WHEREAS, by its Resolution No. 10773, regularly adopted
November 5, 1985, this Council declared its intention to vacate a
portion of that certain Sanitary Sewer and Storm Drain Easement
hereinafter more particularly described, all in accordance with
provisions of the Public Streets, Highways, and Service Easements
Vacation Law (Sections 8320 and following of the Streets and
Highways Code of California), and thereafter caused publication
and posting of notices of said intended vacation as required by
said Law, both said publication and notices fixing the time and
place for hearing all persons interested in the vacation as
Tuesday, December 3, 1985, at 7:30 p.m. in the Council chamber,
City Hall, Alameda, California and
WHEREAS, at said time and place the matter of the
proposed vacation came on regularly for hearing by this Council
and proof of publication and of posting of said notices in the
manner required by law having been made by the City Clerk, and
the Council then having heard all the evidence, both oral and
documentary, proferred by all persons interested in said matter,
and the Council being fully advised in the premises and the
matter thereupon submitted for determination;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that:
(1) It is hereby found and determined that a portion of
the sanitary sewer and storm drain easement in said Resolution of
Intention and hereinafter particularly described is unnecessary
for present or prospective public use, and the public interest
requires vacation of same;
(2) It is hereby ordered that the following portion of a
Sanitary Sewer and Storm Drain Easement be, and it is, vacated:
Being a portion of the existing 25 foot wide P.U.E.
in Lot 1, Block 13, as shown on the map of Tract 1866,
recorded October 30, 1957, in Book 38, Pages 50 through
54 Alameda County, California, as described in Grant
of Easement recorded in Book 8647 Page 71 of Official
Records of the County of Alameda, California. More
particularly described as follows:
COMMENCING at the intersection of the southeasterly
extension of the center line of Franciscan Way with
the southeastern right of way line of Willow Street
as said Way and Street are shown on said map of Tract
1866; thence from said point of commencement along
said scutheastern line of Willow Street, North 26 °11'02"
East 10 feet; thence South 63 °48'58" East 275 feet
to a point herein designated as Station "A"; thence
continuing South 63 °48'58" East 300.64 feet to a point
herein designated as Station "B ", thence North 34°46'41"
East 5.00 feet; thence South 55 °13'19" East 412 -feet
to a point herein as designated as Station "C thence
continuing South 55 °13'19" East 173 feet thence North
34 °46'41" East 65.00 feet; thence South 55°13'19" East
160.00 feet to a point herein designated as Station
"D "; thence continuing South 55 °13'19" East 160 feet;
thence South 34 °46'41" West 65 feet; thence South 55 °13'19"
East 172 feet to a point herein designated as Station
"E "; thence continuing South 55 °13'19" East 28 feet;
thence North 34 °46'41 East 110.05 feet to the True
Point of Beginning of this description; thence from
said True Point of Beginning South 55 °04'34" East 12.50
feet; thence North 34 °46'41" East 92.24 feet; thence
North 10 °13'19" West 35.36 feet, thence South 34 °46'41"
West 117.18 feet;' thence South 55 °04'34" East 12.50
feet to the True Point of Beginning containing 2,618
square feet more or less
BE IT FURTHER RESOLVED that the City Clerk shall cause a
certified copy of this order, attested under seal, to be recorded
in the County Recorder's Office and from and after the date of
said recordation the portion of said sanitary sewer and storm
drain easement vacated no longer shall constitute a sanitary
sewer and storm drain easement.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd of December, 1985,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
