AUTHORIZING EXECUTION OF AGREEMENT WITH THE
UNITED STATES COAST GUARD TO UTILIZE SUBMERGED
TIDAL LANDS FOR MOORING FACILITIES ON COAST
GUARD ISLAND
WHEREAS, the United States Coast Guard has invoked the
right of "Navigational Servitude" to use submerged or tidal
lands for Congressionally authorized improvements that promote
navigation and commerce, even though the United States does not
own title to the land; and
WHEREAS, the Coast Guard plans to construct a new
waterfront facility for its high endurance cutters at Coast Guard
Island, Alameda; and
WHEREAS, the Coast Guard has requested that the City
authorize an agreement with the Coast Guard, that concurs with
the right of "Navigational Servitude" for the use of the tidal
lands;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the certain agreement referred to above is
hereby accepted and the Mayor and City Clerk are hereby
authorized to execute and attest to, respectively, said
- agreement on behalf of the City.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st of January, 1986,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
