ADOPTING STATEMENT OF COMMUNITY DEVELOPMENT OBJECTIVES
AND PROJECTED USE OF FUNDS, AUTHORIZING EXECUTION OF REQUIRED
CERTIFICATIONS AND GRANT AGREEMENT, REPROGRAMMING OF CERTAIN
PRIOR YEARS' CDBG FUNDS AND APPROVING ALLOCATION
OF UDAG LOAN REPAYMENTS
WHEREAS, the City of Alameda is an eligible applicant for
Community Development Block Grant Entitlement Funds as authorized by
the Housing and Community Development Act of 1974, as amended; and
WHEREAS, the City of Alameda is entitled to receive
$697,000 in Twelfth Year CDBG funds; and
WHEREAS, the City of Alameda also will receive $151,816 in
Urban Development Action Grant loan repayments; and
WHEREAS, $175,000 in prior years is available for
reprogramming to eligible projects and activities;
WHEREAS, the City of Alameda has sought and considered
citizens' comments regarding housing and community development needs
in the community; and
Plan;
WHEREAS, the City has prepared a Community Development
NOW, THEREFORE, BE IT RESOLVED that the City of Alameda
does hereby adopt its Statement of Community Development Objectives
and Projected Use of Funds for Fiscal Year 1986-87; and
BE IT FURTHER RESOLVED, that the City of Alameda certifies
its compliance with Community Development Block Grant requirements,
and authorizes the City Manager to execute certifications that:
1. It possesses legal authority to make a grant submission
and to execute a community development and housing program;
2. Its governing body has duly adopted or passed as an
official act a resolution, motion or similar action authorizing the
person identified as the official representative of the grantee to
submit the final statement and all understandings and assurances
contained therein, and directing and authorizing the person
identified as the official representative of the grantee to act in
connection with the submission of the final statement and to provide
such additional information as may be required;
3. Prior to submission of its final statement to HUD, the
grantee has:
(a) met the citizen participation requirements of Section
570.301(a) (2) and has provided citizens with:
(1) the estimate of the amount of CDBG funds proposed
to be used for activities that will benefit persons
of low and moderate income; and
(2) its plan for minimizing displacement of persons as
a result of activities assisted with CDBG funds and
to assist persons actually displaced as a result of
such activities.
(b) prepared its final statement of community development
objectives and projected use of funds in accordance
with Section 570.301(a)(3) and made the final
statement available to public;
4. The grant will be conducted and administered in
compliance with:
(a) Title VI of the Civil Rights Act of 1964 (Pub.L.
88-352; 42 U.S.C. 3601 et seq.);
5. It will affirmatively further fair housing;
6. It has developed its final statement of projected use
of funds so as to give maximum feasible priority to activities which
benefit low and moderate income families or aid in the prevention or
elimination of slums or blight; (the final statement of projected
use of funds may also include activities which the grantee certifies
are designed to meet other community development needs having a
particular urgency because existing conditions pose a serious and
immediate threat to the health or welfare of the community, and
other financial resources are not available), except that the
aggregate use of CDBG funds received under section 106 of the Act
and, if applicable, under section 108 of the Act, during the 1986-87
program year, shall principally benefit persons of low and moderate
income in a manner that ensures that not less than 51 percent of
such funds are used for activities that benefit such persons during
such period;
7. It has developed a community development plan, for the
period specified in paragraph (6) above, that identifies community
development and housing needs and specifies both short and long-term
community development objectives that have been developed in
accordance with the primary objective and requirements of the Act;
8. It is following a current housing assistance plan which
has been approved by pursuant to Section 570.306;
9. It will not attempt to recover any capital costs of
public improvements assisted in whole or in part with funds provided
under section 106 of the Act or with amounts resulting from a
guarantee under section 108 of the Act by assessing any amount
against properties owned and occupied by persons of low and moderate
income, including any fee charged or assessment made as a condition
of obtaining access to such public improvements, unless (A) funds
received under section 106 of the Act are used to pay the proportion
of such fee or assessment that relates to the capital costs of such
public improvements that are financed from revenue sources other
than under Title I of the Act; or (B) for purposes of assessing any
amount against properties owned and occupied by persons of moderate
income, the grantee certifies to the Secretary that it lacks
sufficient funds received under section 106 of the Act to comply
with the requirements of subparagraph (A); and
10. It will comply with the other provisions of the Act
and with other applicable laws.
BE IT FURTHER RESOLVED that the City Manager is hereby
authorized to execute a Grant Agreement for Fiscal Year 1986-87 CDBG
Entitlement Funds with the Department of Housing and Urban
Development.
BE IT FURTHER RESOLVED that the reprogramming of $175,000
in prior years funds is hereby approved; and
BE IT FURTHER RESOLVED that the allocation of Urban
Development Action Grant loan repayments for Fiscal Year 1986-87 is
hereby approved.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 6th of May, 1986,
by the following vote to wit:
