Resolution 10920CITY OF ALAMEDA RESOLUTION NO. 10920 A RESOLUTION PRELIMINARILY APPROVING REASSESSMENT REPORT, APPOINTING TIME AND PLACE OF HEARING PROTESTS AND DIRECTING NOTICE THEREOF MARINA VILLAGE ASSESSMENT DISTRICT 84 -3 (Reassessment & Refunding of 1986) RESOLVED, by the City Council of the City of Alameda, (the "City "), County of Alameda, California, that WHEREAS, on August 21, 1984, this Council adopted Resolution No. 10421, a Resolution of Intention to Levy Reassessments and to Issue Refunding Bonds Upon the Security Thereof, in which said refunding and reassessment were referred to John Heindel, Consulting Civil Engineer, for the purpose of making and filing a report in writing under and pursuant to the Refunding Act of 1984 for 1915 Improvement Act Bonds; and WHEREAS, said report has been made and filed and duly considered by this Council; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. Said report as a whole and each part thereof, to wit: a) a schedule setting forth the unpaid principal and interest on the Prior Bonds (as identified in said Resolution of Intention) to be refunded and the total amounts thereof; b) an estimated of the total principal amount of the reassessment and of the refunding bonds and the maximum interest thereon, together with an estimate of cost of the reassessment and of issuing the refunding bonds, including expenses incidental thereto; c) the auditor's record showing the schedule of principal installments and interest on all unpaid original assessments and the total amounts thereof, all as shown on said record on file in the office of the Director of Finance of the City; d) an estimate of the amount of each reassessment, identified by reassessment number corresponding to the reassessment number of the reassessment diagram, together with a proposed auditor's record for the reassessment; and e) a reassessment diagram showing the assessment district and the boundaries and dimensions of the subdivisions of land therein. are sufficient and are preliminarily approved. 2. Said report shall stand as the Reassessment Report for the purpose of all subsequent proceedings herein. 3. Tuesday, the 1st day of July, 1986, at the hour of 7:30 o'clock p.m., in the regular meeting place of this Council, City of Alameda, Council Chambers, 2263 Santa Clara Avenue, Alameda, California, be, and the same are hereby appointed and fixed as the time and place when and where this Council will consider and finally determine whether the public interest, convenience and necessity require said refunding and reassessment, and when and where it will consider and finally act upon said Reassessment Report. 4. The City Clerk shall cause notice of said hearing to be given by publication twice in the Times Star, a newspaper published and circulated in the City. The first publication of said notice shall be made at least ten days before the date herein set for said hearing and the second shall be at least five days after the first. Said notice shall be headed "Notice of Reassessment" and shall, in legible characters, state and contain: the fact and date of the adoption of said Resolution of Intention; the filing of said report; the time, place and purpose of the hearing on said resolution and report; the total estimated cost of the proposed reassessment and refunding; and a brief description of the proposed refunding and reassessment; a statement that any person interested may file a protest in writing as provided in Division 11.5 of the Streets and Highways Code; and reference to said resolution and report for further particulars. 5. Said Clerk shall also cause notice of said hearing to be mailed, postage prepaid, at least twenty days before the date herein set for said hearing, to all persons owning real property to be reassessed whose names and addresses appear on the last equalized assessment roll for general taxes or are known to said Clerk. Said notices shall contain, in addition to the matters provided above for the notice to be published, the amount, as shown by said report, to be reassessed against the particular parcel covered by each such notice, respectively. Said notices shall be mailed to such owners at their addresses as same appear on said assessment roll, or as known to said Clerk, or to both if not the same. * * * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 3rd of June, 1986, by the following vote to wit: AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
