ORDERING VACATION OF PUBLIC UTILITY EASEMENT
LOCATED WITHIN TRACT 3865 (NORTH OF SOUTH
SHORE BEACH AND TENNIS CLUB)
WHEREAS, by its Resolution No. 11099 regularly adopted
February 3, 1987, this Council declared its intention to vacate a
portion of that certain Public Service Easement hereinafter more
particularly described, all in accordance with provisions of the
Public Streets, Highways, and Service Easements Vacation Law
(Sections 8320 and following of the Streets and Highways Code
of California), and thereafter caused publication and posting of
notices of said intended vacation as required by said Law, both
said publication and notices fixing the time and place for
hearing all persons interested in the vacation as Tuesday, March
3, 1987, at 7 :30 p.m. in the Council Chamber, City Hall, Alameda,
California; and
WHEREAS, at the request of Pacific Bell said hearing was
continued to Tuesday, March 17, 1987, at 7 :30 p.m. in the Council
Chamber; and
WHEREAS, at said time and place the matters of the
proposed vacation came on regularly for hearing by this Council
and proof of publication and of posting of ssid notices in the
manner required by law having been made by the City Clerk, and
the Council then having heard all the evidence, both oral and
documentary, proferred by all persons interested in said
matter, and the Council being fully advised in the premises and
the matter thereupon submitted for determination;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that:
(1) It is hereby found and determined that the Public
Utility Easement in said Resolution of Intention and hereinafter
particularly described is unnecessary for present or prospective
public use, and the public interest requires vacation of same;
(2) It is hereby ordered that the following public
service easement within Lots 20 and 21 of Tract 3865 (Maintenance
access to a Bureau of Electricity pole line) being a 6' P.U.E. as
shown on that certain map entitled "TRACT 3865 LOT 3 BLOCK 11
TRACT 1898 ALAMEDA, CALIFORNIA" filed April 16, 1979, Series No.
79- 070220 in Book 110 of Maps at Pages 25 and 26, Alameda County
Records, Alameda, California, be and it is vacated:

COMMENCING at the most Southwestern corner of Lot 20 of
the above referenced map.
THENCE North 26° 11' 02" East 6.00 feet to the TRUE
POINT OF BEGINNING;
THENCE North 26° 11' 02" East 6.00 feet;
THENCE South 63° 48' 58" East 255.63 feet;
THENCE South 18° 16' 36" West 6.06 feet;
THENCE North 63° 48' 58" West 256.46 feet to the TRUE
POINT OF BEGINNING;
Containing .0353 acres of land more or less.
BE IT FURTHER RESOLVED that the City Clerk shall cause a
certified copy of this order, attested under seal, to be recorded
in the County Recorder's Office and from and after the date of
said recordation the Public Utility Easement vacated no longer
shall constitute a public utility easement.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 17th day of March, 1987
by the following vote to wit:
