SUPPORTING ADOPTION OF ASSEMBLY BILL 1486 RELATING
TO APPROVAL OF DEVELOPMENT PROJECTS
WHEREAS, Section 65956 of the California Government Code
which was added by the Permit Streamlining Act (AB 884)
requires that a permitting agency act on a subdivision project
permit application within one year of the date of application
and provides that the permit is approved by operation of law
if no action is taken within the year; and
WHEREAS, concern has been expressed by some legislators
that projects inconsistent with zoning ordinances and other
law may be approved without according due process to affected
members of the public; and
WHEREAS, Assembly Bill 1486 has been introduced by
Assembly Member Sher to address these issues; and
WHEREAS, AB 1486 would strengthen the process for
management of AB 884 regulations by placing the burden for
implementing automatic approvals on the applicant whom they are
intended to benefit; and
WHEREAS, AB 1486 would almost totally preclude automa-
tic approvals through neglect of intentional lack of action on
applications; and
WHEREAS, AB 1486 appears to have a demonstrable public
benefit;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that said Council expresses its support of
AB 1486 and urges favorable consideration of said bill by the
Legislature.
BE IT FURTHER RESOLVED that copies of this resolution be
sent to the author of the Bill, Assembly Member Byron D. Sher,
and the Legislators representing the City of Alameda.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in adjourned regular
meeting assembled on the 28th of April, 1987,
