Resolution 11181CITY OF ALAMEDA RESOLUTION NO. 11181 URGING THE LEGISLATURE TO AMEND SB300 RELATING TO ADDITIONAL ALLOCATIONS TO CITIES AND COUNTIES FOR STREETS AND HIGHWAYS MAINTENANCE AND RECONSTRUCTION WHEREAS, SB300, FORAN, approved by the Governor on October 2, 1985, provided for additional allocations to Cities and. Counties for streets and highways maintenance and reconstruction; and WHEREAS, SB300 further provides that in order to receive an allocation, an agency must spend not less than its 1984-85 (base year) expenditures for maintenance and reconstruction not includ- ing the allocation; and WHEREAS, if the State Controller determines that a City or County expended less than its 1984-85 base year amount, its allocation pursuant to Section 2104 or 2107 gas taxes shall be reduced during the next fiscal year by the amount that its expenditures are less than the base year amount; and WHEREAS, there are 112 Cities, and 8 Counties that did not meet their base year 1984-85 expenditure requirements, and there- fore, are in jeopardy of losing 2104 or 2107 gas tax allocations for the 1986-87 fiscal year; and WHEREAS, the designation of the 1984-85 fiscal year as the base years is unfair, due to the year-to-year fluctuations of monies spent for street purposes by local agencies; and in any case, 2104 and 2107 gas taxes which local agencies have received and depended on for 25 years should not be curtailed. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that said Council hereby urges the legislature to amend SB300 (or Sec. 2127 of the Streets and Highways Code) to accomplish the following: (1) Allow the local agency to use an average of years for the base year instead of the 1984-85 fiscal year. (2) Delete the provision for the reduction of 2104 or 2107 gas tax funds as a penalty for not meeting the expenditure requirements. (3) Since some Cities have not spent their allocations because it may become a liability - allow more time for expenditure of the allocations. BE IT FURTHER RESOLVED that because of budgetary constraints, time is of the essence. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in adjourned regular meeting assembled on the 28th of April, 1987, by the following vote to wit: AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
