AUTHORIZING UNITED CABLE TO INSTALL ALL ACTIVE
ELECTRONIC DEVICES AND PASSIVE SUBSCRIBER TAPS
IN ABOVEGROUND PEDESTALS AND APPROVING NEW RULES,
REGULATIONS, AND STANDARDS FOR THE INSTALLATION
OF CATV CABLE IN UNDERGROUND AREAS
WHEREAS, the franchise agreement between United Cable and
the City of Alameda requires that the City approve aboveground
installation in underground areas; and
WHEREAS, expert opinion has been received concerning
whether or not it is technically reasonable to underground
active electronic devices and passive subscriber taps; and
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Alameda hereby authorizes United Cable Television to
install active electronic devices and passive subscriber taps in
aboveground pedestals; and
BE IT FURTHER RESOLVED that regulations therefore
attached hereto as Attachment A are adopted regulating the
location and installation of aboveground pedestals for the CATV
cable installation in underground areas.

ATTACHMENT A
NEW RULES, REGULATIONS, AND STANDARDS FOR CABLE INSTALLATION
IN UNDERGROUND AREAS:
I. Effective August 5, 1987, two-weeks advance notice of
rebuild activity shall be sent by Certified Mail to each
effected property owner where pedestals are proposed to be
located. The notice shall explain the purpose of the
rebuild, contain a physical description of the pedestal
including a sketch or picture, the number of pedestals per
block, and their approximate proposed location in the
easements. The notice will also provide the name and phone
number for United's contact person to answer questions and
specify the procedure for identifying alternate locations
for the proposed pedestal. Three days before the proposed
construction a notice will be hand-delivered to each
effected property re-stating the policy on pedestal
placement and reminding the resident of the commencement of
construction.
2. Effective August 5, 1987, placement of pedestals in the
Public Right-of-Way and the Public Utility Easement shall be
at least three feet from any curb or as approved by the
Public Works Director for areas where this placement may not
be feasible or practical.
3. Effective August 5, 1987, to the maximum extent possible,
pedestals shall be placed next to larger objects, e.g.,
existing mailbox-posts, trees, or other aboveground
appurtenances.
4. Effective August 5, 1987, 60 days following the activation
of service, all pedestals shall be screened by substantial
planting clusters of at least 18 inches in height, 20 inches
in width and 8 inches in depth and mantained during the
first full year by the cable company to make certain they
grow to maturity and tastefully conceal the pedestals.
5. Effective August 5, 1987, a State licensed landscape
architect shall be retained under contract by United to
design and supervise landscape treatment for the
pedestals. Minimizing liability and low maintenance costs
are of paramount importance. All such landscape material
shall be from an approved list of plants and shrubs.
6. Effective August 5, 1987, all proposed aboveground cable
appurtenances shall be shown on an instrument to be recorded
with the Alameda County Recorder's Office for each parcel
within a proposed new development.

7. Effective August 5, 1987, and continuing through the finish
of construction in underground areas, the Cable Television
Oversight Committee shall announce and hold monthly meetings
to hear citizens' concerns regarding the rebuild.
8. Effective August 5, I987, the cable operator shall hold
publicized meetings with all homeowners' associations well
in advance of construction in the effected underground
areas.
9. Effective August 5, 1987, all pole-mount construction shall
be to the City's satisfaction. United Cable will reimburse
the City for inspection expenses. All cable droplines are
to be at a 90 degree angle from the main feeder line.
10. Effective August 5, 1987, United will work with homeowners
in the placement of pedestals on private property and give
the homeowners first choice of location.
11. A standard easement agreement will be drafted and made
available through the City Attorney's office.
