RESOLUTION CREATING THE POLICE ASSET SEIZURE
FUND, ALLOCATING $100,000 FROM SAID FUND TO
THE POLICE SECRET FUND, AND DIRECTING THAT ALL
INTEREST DERIVED FROM SAID FUNDS BE CREDITED
TO THE POLICE ASSET SEIZURE FUND
WHEREAS, under the provisions of the Comprehensive Crime
Control Act of 1984, and California Health and Safety Code
Section 11470, state and local enforcement agencies are permitted
to receive a portion of monies and property they seize in the
course of a narcotics investigation; and
WHEREAS, the seized money or property must be used for
narcotic related law enforcement purposes; and
WHEREAS, the Drug Enforcement Administration (D.E.A.) and
State Department of Justice will conduct audits of fund receiving
agencies to ensure compliance with the law; and
WHEREAS, all asset seizure monies should be deposited in
a City Fund separate from the General Fund; and
WHEREAS, in order to keep the fund self sustaining, the
money should be placed in interest bearing accounts with the
interest credited to the "Asset Seizure Fund"; and
WHEREAS, the City has received the sum of $391,824 from
the D.E.A. for the City's involvement in one case; and
WHEREAS, approximately $100,000 should be appropriated to
the "Secret Fund" to be used in police covert narcotics
operations with the remaining money deposited in the "Asset
Seizure Fund" for other police or narcotics related operations;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that pursuant to California Health and Safety Code
Section 11470 and Title 21 of the United States Code there is
hereby created the Police Asset Seizure Fund for vice related
operations as recommended by the Chief of Police and approved by
the City Manager; and
BE IT FURTHER RESOLVED the sum of $100,000 is hereby
allocated from the Police Asset Seizure Fund to the Police Secret
,.ti Fund for covert narcotics operations; and
BE IT FURTHER RESOLVED that all interest derived from the
C \k;
Police Asset Seizure Fund and Secret Fund be credited to the
Police Asset Seizure Fund.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed 'by
the Council of the City of Alameda in regular meeting
assembled on the 18th of August, 1987,
by the following vote to wit:
AYES: Councilmembers Camicia, Haugner, Monsef, Thomas
and President Corica - 5.
NOES: None.
ABSENT: None.
