Resolution 11273CITY OF ALAMEDA RESOLUTION NO. 11273 APPROVING THE DESTRUCTION OF CERTAIN CITY RECORDS, DOCUMENTS, AND PAPERS WHEREAS, the Chief of Police has submitted a request for authority to destroy obsolete records; and WHEREAS, said request has been approved by the City Attorney, is recommended for approval by the City Manager, and is in accordance with the procedures and requirements of the city and Section 34090 et seq. of the California Government Code; and WHEREAS, the Chief of Police has stipulated the useful retention period for the Police Department records; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that: 1. The following city records, documents, instruments, books or papers are no longer required: (a) Bicycle auction receipts and records over two (2) years old. (b) Records of expired bicycle licenses over two (2) years old. (c) Records of lost and found items over two (2) years old. (d) Miscellaneous non - criminal officer's contact reports over two (2) years old. (e) Police Daily Activity records over two (2) years old. (f) All miscellaneous non- criminal reports, all arrest reports and crime reports of infractions, misdemeanors, and felonies over five (5) years old, providing: (1) It does not have an unserved warrant. (2) It does not involve a stolen firearm which has not been recovered. (3) It is not classified 290 Penal Code or 11590 Health and Safety Code. 1 0 05- 0 ti) c m . ' BE IT FURTHER RESOLVED that City of Alameda Resolution No. 10820 adopted on February 5, 1986, is hereby rescinded in its entirety. (4) It is not a death case. (5) It does not include violations listed in Penal Code Section 800. (6) The case is not presently involved in either civil or criminal litigation. (g) Unserved felony warrants and corresponding cases over ten (10) years old. (h) All index cards and logs which relate to the cases destroyed. (i) Police dispatch cards over two (2) years old. (j) Field investigation cards over two (2) years old. (k) Notice to Appear citation file copies maintained at the department over two (2) years old. (1) Parking violations citation file copies maintained at the department over two (2) years old, providing: no parking violation citation shall be destroyed until it has been subject to audit by the County Auditor's office. 2. The records, documents, instruments, books and papers specified in Paragraph 1 of this resolution do not include: any documents relating to citizen complaints or investigations in response to citizen complaints relating to members of the Police Department, internal affairs investigation files, and coroner's cases. These are governed by the Penal Code. > 0 2 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th of August, 1987, by the following vote to wit: AYES: Councilmembers Camicia, Haugner, Monsef, Thomas and President Corica - 5.
