Resolution 11295CITY OF ALAMEDA RESOLUTION NO. 11295 ORDERING VACATION OF A PORTION OF THE ELECTRICAL EASEMENT AT 568 CENTRAL AVENUE BE IT RESOLVED by the Council of the City of Alameda that a portion of that certain Public Utility Easement established by a City of Alameda resolution adopted on April 6, 1982, located over the western ten (10) feet of the property located at 568 Central Avenue and described as: A portion of existing ten-foot (10') easement and right-of-way, for electrical power facilities and their appurtenances, as described in City of Alameda Resolution No. 9727, situated in the City of Alameda, County of Alameda, State of California, more particularly described as follows: COMMENCING at the intersection of the southern line of Central Avenue with the common boundary line between Aughinbaugh's 223.374 acre tract and Chipman's west tract of 111.687 acres, as shown on that certain map entitled "Duplicate Map of E.S. Chipman's Acre Lots According to Survey of Washington Woodward...," filed June 19th, 1858, in Book 19, Page 61, in the Office of the Alameda County Recorder; THENCE southerly at right angles, along said boundary line, 100 feet; THENCE westerly at right angles, 20 feet to a point of the eastern line of said easement, being also the POINT OF BEGINNING; THENCE continuing westerly along the southern line of said easement, 5 feet; THENCE northerly parallel to the western line of Sixth Street, formerly Third Avenue, as shown on the "Map of the Lands of the Teutonia Park and Homestead Association," filed March 10th, 1877 in Map Book 5, Page 5, in the Office of the Alameda County Recorder, 100 feet to a point on the aforesaid southern line of Central Avenue, formerly Washington Avenue, as shown on said map; THENCE easterly along said southern line, 5 feet to a point on the eastern line of said easement; THENCE southerly along said eastern line 100 feet to the POINT OF BEGINNING. 1 Containing: 500 square feet, more or less. is hereby ordered vacated pursuant to the provision of Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8333 thereof. \ BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (1) the said easement ordered vacated herein is unnecessary for present or prospective !, public use, and (2) that said easement has never been used by s the City of Alameda for any purpose whatever since the date of its acquisition to the date of this resolution. , ,,- BE IT FURTHER RESOLVED that the City Clerk shall cause p certified copies of this order, attested under seal, to be recorded in the County Recorder's Office and from and after the `V ,,,,_ date this resolution is recorded the public utility easement co vacated no longer shall constitute a public utility easement. 0 ca, 2 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed =by the Council of the City of Alameda in regular meeting assembled on the 15th of September, 1987, by the following vote to wit: AYES: Councilmembers Camicia, Haugner, Thomas and President Corica - 4.
