ACCEPTING EASEMENT AGREEMENT WITH BAY HARBOR
VENTURE FOR ACCESS TO AN EXISTING PUBLIC
UTILITIES EASEMENT AT THE SOUTHEAST CORNER
OF AUGHINBAUGH WAY AND SHEFFIELD ROAD AND
AUTHORIZATION THEREOF
WHEREAS, the Bureau of Electricity has installed a
transformer pad within a Public Utilities Easement (P.U.E.)
located at the southeast corner of Aughinbaugh Way and
Sheffield Road; and
WHEREAS, at the time of the establishment of said P.U.E.
the property surrounding it consisted of large tracts of unfenced
land slated for future subdivision; and
WHEREAS, subsequent roadway construction rendered a
portion of the P.U.E. unusable for the installation of a
transformer pad resulting in the transformer being installed such
that six to eight feet of access clearance is necessary on the
east and south sides of the pad; and
WHEREAS, the developer complied with a request by the
Bureau of Electricity for an additional easement for
maintenance access by offering an easement agreement which will
terminate upon removal of the adjacent electrical power
equipment; and
WHEREAS, the owner of this property would like to enter
into this easement agreement prior to the sale of the property;
and
WHEREAS, said easement agreement has been reviewed to the
satisfaction of the City Engineer, the City Attorney and the
Bureau of Electricity; and
WHEREAS, said easement agreement has been submitted to
this Council, and the Council is fully informed and aware of the
terms and conditions thereof; and
WHEREAS, it is in the best interests of the City of
Alameda that said agreement be entered into;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the aforementioned easement agreement by and
between the City of Alameda and Bay Venture for Access to an
Existing Public Utilities Easement at the Southeast Corner of
Aughinbaugh Way and Sheffield Road is hereby accepted on behalf
of the City of Alameda, and said Council, acting for and on

behalf of said City, hereby consents to the recordation of said
easement agreement, and orders this resolution to be attached
thereto, as required by Section 27281 of the Government Code of
the State of California.
z BE IT FURTHER RESOLVED that the City Manager is hereby
authorized and directed to execute, for and on behalf of the

City, said easement agreement.

Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 20th of October, 1987,
by the following vote to wit:
AvES: Councilmembers Camicia, Haugner, Monsef, Thomas
and President Corica - 5.
NOES: None.
ABSENT: None.
