AMENDING THE EXISTING DISADVANTAGED BUSINESS
PROGRAM IN ACCORDANCE WITH THE 1987 SURFACE
TRANSPORTATION AND UNIFORM RELOCATION ASSISTANCE
ACT
WHEREAS, on January 3, 1984, the Council of the City of
Alameda, by Resolution No. 10231, established a Disadvantaged
Business/Woman-Owned Business Enterprises (DB/WBE) program; and
WHEREAS, the California Department of Transportation
(CalTrans) directive of March 28, 1988 that all local agencies
amend their DB/WBE programs to coincide with the 1987 Surface
Transportation and Uniform Relocation Assistance Act (ACT) states
that the amendment to the agency's existing DB/WBE program can be
accomplished by holding a public hearing and passing a City
Council Resolution; and
WHEREAS, on June 21, 1988 said Council, by Resolution No.
11483, set July 5, 1988 as the date for a public hearing to amend
the City's existing Disadvantaged Business Program; and
WHEREAS, said public hearing on the proposed amendments
was held; and
WHEREAS, said Council, as a result of the public hearing,
has establish d that:
1) The ACT presumes that women are socially and
economically disadvantaged individuals whose
participation may be counted in attaining "DB"
goals; and
2) As such, separate Woman Business Enterprise, "WBE",
goals will no longer be used and the terms "DB" and
"WBE" in the current adopted program shall be
understood to mean "DB".
WHEREAS, at the conclusion of the hearing, it was
determined that the amendments to the City's existing
disadvantaged business program will have a beneficial impact
upon the safety and welfare to the community.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that said Council hereby amends the City's Existing
Disadvantaged Business Program in accordance with the
abovementioned amendments.
