ESTABLISHING PERMANENT PUBLIC ACCESS AT SHORELINE
AREA ADJACENT TO BAYVIEW ESTATES
WHEREAS, on July 16, 1987, the City of Alameda filed a
permit application with the San Francisco Bay Conservation and
Development Commission ( B.C.D.C) to resolve the problems of
illegal fill and shoreline erosion on City property at two
locations between Broadway and the Ravens Cove development; and
WHEREAS, in March 1988 said permit was approved by
B.C.D.0 with a requirement that the City provide a public
access easement covering the two areas where the improvement work
will take place; and
WHEREAS, two easement dedications titled "Public Access
Easement At The East End Bayview Estates Shoreline" and "Public
Access Easement Bayview Estates Shoreline In Vicinity Lagoon
Outfall" have been prepared by the City of Alameda Engineering
Department and approved by B.C.D.C., attached hereto as Exhibit A
and B, respectively; and
WHEREAS, the public access easement providing said access
complies with B.C.D.0 requirements, creating public access which
cannot be revoked without the mutual consent of the City of
Alameda and B.C.D.C.;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that said Council hereby approves the easement
dedications establishing permanent public access at the shoreline
area adjacent to Bayview Estates.
BE IT FURTHER RESOLVED that the Mayor of the City of
Alameda is hereby authorized to accept, on behalf of the public
and the City of Alameda, said dedications.

The City of Alameda, a municipal corporation, hereby reserves unto
itself, and dedicates to the public, a permanent easement and right-of-way,
exclusively for public access uses, to include walking, sitting, bicycling,
Picnicking, viewing, and related Purposes, excluding however, and hereby
expressly prohibiting, acceaa or use by or by means of any wheeled vehicles or
other wheeled device of any kind whatsoever, excepting wheelchairs, bicYoles,
and emergency and maintenance vehdcles. Said easement may not be vacated
without the prior express written authorization of the San Francisco Bay
Conservation and Development Commission or its Executive Director. The said
easement is defined and described ea follows:
A parcel or tract of land situate in the City of Alameda, County of
Alameda, State of California, deacribed as follows:
Being a portion of the tide and submerged lands of San Francisco Bay in
the immediate vicinity of the San Leandro Channel, and immediately adjacent to
the southwestern boundary of Tract No. 2537, as shown on the map thereof,
recorded February 20, 1964 in Book 48 of Maps, at page 42, Official Records of
Alameda County, California, and the southwestern boundary of Tract 3411, as
shown on the map thereof, recorded October. 26, 1972 in Book 48 of maps, at page
42, Official Records of Alameda County, California, and further described as
follows;
BEGINNING at the most southeastern co or of said Tract No. 2537, said point
also being the most southwestern corner of said Tract No, 3411;
THENCE South 67°25'10" East, 30.00 feet along said boundary of Tract No. 3411;
THENCE South 22°34'50" West, 55.00 feet;
THENCE North 67°25'10" West, 216.94 feet;
THENCE North 22°34'50" East, 55.00 feet, to a point on said boundary of Tract
No. 2537;
THENCE South 67°25'10" East, 186.94 feet along said boundary to the BEGINNING.
Containing 11,931.70 sq. ft. (0.274 of an acre), more or less.
