CITY OF ALAMEDA RESOLUTION NO. 11616
PROPOSING AN AMENDMENT TO THE CHARTER OF THE CITY
OF ALAMEDA UPON MOTION OF THE CITY COUNCIL; CALLING
A MUNICIPAL CHARTER AMENDMENT ELECTION IN THE CITY
OF ALAMEDA FOR THE PURPOSE OF SUBMITTING TO THE
ELECTORS THEREOF A PROPOSAL TO AMEND SAID CHARTER,
VIZ: BY AMENDING SECTION 10 -1 AND ADDING ARTICLE
XXVIII ESTABLISHING THE HISTORICAL ADVISORY BOARD;
FIXING DATE OF SAID ELECTION, MANNER OF HOLDING
SAME, AND PROVIDING FOR NOTICE THEREOF; AND
CONSOLIDATING SAID MUNICIPAL CHARTER AMENDMENT
ELECTION WITH THE GENERAL MUNICIPAL ELECTION OF
THE CITY OF ALAMEDA TO BE HELD ON MARCH 7, 1989
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA as
Section 1. The Council of the City of Alameda hereby
proposes on its own motion to amend the Charter of the City of
Alameda by amending Section 10 -1 and adding Article XXVIII thereof,
to read as set forth in the printed pamphlet provided for in Section
6 hereof, and in the notice entitled, "Proposed Amendments to the
Charter of the City of Alameda" hereinafter set forth in Section 3
hereof.
Section 2. The Council of the City of Alameda hereby
proposes to and does hereby on its own motion submit to the
qualified electors of the City of Alameda, at the Municipal Charter
Amendment Election hereinafter provided for, a proposal to amend the
Charter of the City of Alameda as set forth in said notice
hereinafter set forth in Section 3 of this resolution and designates
and refers to said proposal as the proposal to be set forth in the
form of ballot hereinafter prescribed for use at said Charter
Amendment Election.
Section 3. The City Clerk of the City of Alameda is hereby
ordered and directed to cause said proposed amendments to the
Charter of the City of Alameda to be published once, not less than
forty (40) and not more than sixty (60) days prior to the date of
the Charter Amendment Election hereinafter provided for, in the
ALAMEDA TIMES STAR, the official newspaper of said City, and in each
edition thereof during the day of publication, said newspaper being
a newspaper of general circulation published at least six days a
week in said City of Alameda; and such publication may be in
substantially the following form:

Municipal Charter Amendment Election March 7, 1989
(Consolidated with General Municipal Election
of the City of Alameda)
The Council of the City of Alameda hereby proposes on its
own motion to amend the Charter of the City of Alameda:
1. By amending Section 10 -1 to read:
Sec. 10 -1. The following Boards are hereby
established:
Public Utilities Board; Civil Service Board;
City Planning Board; Social Service Human Relations
Board; Library Board; Historical Advisory Board.
2. By adding Article XXVIII to read:
ARTICLE XXVIII
Historical Advisory Board
Sec. 28 -1. BOARD CREATED -- PURPOSE. In order
to encourage broad community participation in the
history of Alameda, and preserve and protect
structures, sites and areas of historical significance
in the City, there is hereby created the Alameda
Historical Advisory Board, hereinafter referred to as
the Board, which shall be appointed and organized, and
shall have responsibilities, as hereinafter set forth.
Sec. 28 -2. POWERS AND DUTIES. The purposes,
powers, procedures and duties of the Board shall be
those set forth in Chapter 9 of Title X of the Alameda
Municipal Code.
Sec. 28-3. ESTABLISHMENT AND COMPOSITIONS There
is hereby established an Historical Advisory Board
composed of five (5) members, appointed by the Alameda
City Council and serving without pay. The members
shall have demonstrated an interest in the history,
heritage and architecture of the City of Alameda and
shall be residents of the City.
Sec. 28 -4. TERMS OF OFFICE: Members shall serve
for a term of four (4) years and may be re- appointed
for a second term of office. Terms shall be staggered
so that the number of terms expiring any year shall not
differ more than one from the number of terms expiring
in any other year Members shall serve until their
successors are appointed. Current members of the
Commission shall have their terms decided by lot and
their present terms shall not be considered.
Sec. 28-5. VACANCY AND REMOVALS: Vacancies
which may occur on the Board shall be filled by
appointment of a new member by the City Council for the
duration of an unexpired term of office. A person may
be removed, by the City Council, for termination of
residency, malfeasance or moral turpitude.
Sec. 28 -6. ORGANIZATION: The Board shall hold
regular meetings on the first Thursday of each month in
the City Council Chambers, unless proper notification
is given for a change of location or time.
(A) The Board shall elect a Chairperson and a
Vice - Chairperson from their membership. Each
office shall be for one (1) year However, an
office holder may be returned to office.
"Robert's Rules of Order" shall be used in the
conduct of all meetings.
(B) Three (3) members shall constitute a quorum and a
decision of the Board shall be determined by a
majority vote of those members present at the
meeting.
(C) A public record shall be kept by the Board of its
resolutions, motions and actions. The City
Manager shall provide such technical,
administrative and clerical assistance as may be
required.
Sec. 28 -7. FEES: All fines, fees and other
monies arising out of the administration of the
Historical Advisory Board of the City, or gifts or
trusts therefor shall be deposited in the Historical
Advisory Board Fund. The schedule of fines and fees
shall be adopted by the City Council. Expenditures
from the fund shall be approved by the Council.
The Council of the City of Alameda hereby proposes to and
does hereby on its own motion submit to the qualified electors of
said City at a Charter Amendment Election to be held in said City
on Tuesday, March 7, 1989, (which said election will be consolidated
with the General Municipal Election to be on March 7, 1989),
the following proposals to amend the Charter of the City of Alameda,
in the manner hereinabove specifically set forth, as follows:

Section 4. (a) A Municipal Charter Amendment Election is
hereby called to be held in the City of Alameda on Tuesday, March 7,
1989, for the purpose of submitting to the qualified electors of
said City said proposal set forth in Section 3 of this resolution
to amend the Charter of said City as in said proposal and in this
resolution provided and as hereby submitted by the Council of the
City of Alameda on its own motion.
(b) Said Charter Amendment Election hereby called shall be
held and conducted, and the votes thereat canvassed and the returns
thereof made, and the results thereof ascertained and determined as
herein provided, and in all particulars not prescribed in this
resolution, said Charter Amendment Election shall be held as
provided for in the Charter of said City and in all particulars not
provided for therein said election shall be held as provided by law
for the holding of special municipal elections in the City of
Alameda, and otherwise in accordance with the Elections Code of the
State of California.
(c) All persons qualified to vote at municipal elections in
said City of Alameda on the day of the election herein provided for
shall be qualified to vote upon said amendments hereby proposed by

the Council of the City of Alameda on its own motion and submitted
at said Charter Amendment Election.
(d) The polls at the polling places hereinafter designated
for said Charter Amendment Election shall be opened at 7:00 a.m.
(P.S.T.) of said day of election, and shall be kept open
continuously thereafter until 8:00 p.m. (P.S.T.) of said day of
election when the polls shall be closed (except as provided in
Section 14436 of the Elections Code), and the election officers
shall thereupon proceed to canvass the ballots cast thereat.
(e) Said Charter Amendment Election shall be and is hereby
consolidated with the General Municipal Election of the City of
Alameda to be held in said City on the date of said Charter
Amendment Election hereby called, and the election precincts,
polling places and voting booths shall in every case be the same,
and there shall be only one set of election officers in each of said
precincts; and the precincts, polling places and officers of
election for said Charter Amendment Election shall be the same as
those designated by the City Clerk for said General Municipal
Election by resolution, to which resolution reference is hereby made
for a designation of the precincts, polling places and election
officers for the Charter Amendment Election hereby called.
(f) Only one form of ballot shall be used at said General
Municipal Election of the City of Alameda and said Charter Amendment
Election hereby consolidated therewith, which, in addition to all
other matters required by law to be printed thereon, shall state the
measures set forth in Section 3 hereof.
(g) Each voter may vote on any one or more of the proposed
Charter amendments. To vote in favor of the proposal to amend the
Charter of the City of Alameda a voter shall stamp a cross (X) in
the blank space opposite the word "YES" on the ballot to the right
of the proposal, and to vote against said proposal a voter shall
stamp a cross (X) in the blank space opposite the word "NO" on the
ballot to the right of said proposal. The votes cast for and
against the proposed charter amendments shall be counted separate
and apart from all other measures to be submitted at the Charter
Amendment Election hereby called for the purpose of submitting said
charter amendments, and if a majority of the qualified voters voting
on a proposed charter amendment vote in favor thereof, such charter
amendment shall be deemed ratified.
(h) The returns of said election shall be canvassed, made
out and signed by the election officers and the results thereof
transmitted to the City Clerk of Alameda, and City Council thereof,
who shall declare the result thereof in accordance with the Charter
of the City of Alameda and the laws of the State of California.
Section 5. Said measures and each of them set forth in
Section 3 hereof shall be set forth in the election proclamation and
notice of Charter Amendment Election consolidated with the General

Municipal Election of the City of Alameda to be held on Tuesday,
March 7, 1989, to be published in the time and form required by
Section 22835 of the California Elections Code and Section 6066 of
the California Government Code.
Section 6. The City Clerk of the City of Alameda is hereby
authorized and directed (1) to cause copies of the text of said
proposed charter amendments to be printed in convenient pamphlet
form and in type of not less than eight-point and to cause copies
thereof to be mailed to each of the qualified electors of said City,
and (2) until the day fixed for said Charter Amendment Election to
advertise daily in the ALAMEDA TIMES-STAR, a newspaper of general
circulation in said City, a notice that copies of said pamphlet may
be had on application therefor. Said notice shall be substantially
in the following form:
NOTICE OF AVAILABILITY OF CHARTER AMENDMENTS
NOTICE IS HEREBY GIVEN to the qualified electors of the City
of Alameda that pamphlet copies of the amendments, proposed by the
City Council on its own motion, to the Charter of the City of
Alameda amending Section 10-1 and adding Article XXVIII thereof,
providing for various changes in said Charter as specifically set
forth in said pamphlet copies, which shall be mailed to each of the
qualified electors of said City, are on file in the office of the
City Clerk, City Hall, Alameda, California. Copies of said pamphlet
are available in said office and may be had on application therefor.
