SUPPORTING INDEPENDENT SERVICE STATION FRANCHISES,
ASSEMBLY BILL 2197 (INDEPENDENT PETROLEUM MARKETING
ACT)
WHEREAS, according to the California Service Station and
Automotive Repair Association, the number of service stations in
California has declined significantly over the past 25 years
while the number of registered automobiles and licensed drivers
has increased; and
WHEREAS, there is concern that many of the services and
equipment usually available at service stations, i.e., batteries,
windshield wipers, fan belts, etc., may be phased out as
complete-service gasoline stations are converted to quick-stop
gas-and-liquor stores; and
WHEREAS, many elderly, disabled and lower-income people
have come to depend on the availability of complete-service
gasoline stations; and
WHEREAS, Assembly Bill 2197 would make it unlawful for
any major oil refiner to directly operate other than through a
franchise, a service station not under the direct operation of
the refiner as of January 1, 1990, unless the refiner receives
a permit for direct operation of the station from the local
Planning Board; and
WHEREAS, the specific concerns and needs of local
citizens would be make known to the Planning Board during the
hearing process and made a condition of issuance of the use
permit.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Alameda does hereby endorse Assembly Bill 2197 sponsored
by the California Service Station and Automotive Repair
Association to preserve and defend local automotive maintenance
options and needs through protection of local, independent
service station dealers against "unfair" and "unreasonable" oil
company practices.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 18th of April, 1989,
by the following vote to wit:
