Resolution 11721CITY OF ALAMEDA RESOLUTION NO. 11721 ESTABLISHING THE SECTION OF PRIVATE ROADWAY ON SHERMAN STREET NORTH OF EAGLE AVENUE (ALAMEDA BELT LINE RAILROAD RIGHT-OF-WAY) TO BE SUBJECT TO PROVISIONS OF THE CALIFORNIA VEHICLE CODE AND AUTHORIZING THE INSTALLATION OF STOP SIGNS ON SHERMAN STREET AT THE ALAMEDA BELT LINE RIGHT-OF-WAY WHEREAS, the City of Alameda has been in negotiations with Alameda Belt Line Railroad to maintain public access across the section of private roadway on Sherman Street north of Eagle Avenue; and WHEREAS, one of the major points was police enforcement of stop signs at the railroad crossing itself; and WHEREAS, provisions of the California Vehicle Code apply to privately owned and maintained roads when a resolution is passed in accordance with Code Section 21107.5; and WHEREAS, under Public Utilities Commission regulations for private crossing, vehicular traffic can be controlled by stop signs at a railroad crossing; and WHEREAS, when the street becomes a public street, railroad crossing arms would be required and the stop signs would be removed; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that said Council hereby establishes the section of private roadway on Sherman Street North of Eagle Avenue (Alameda Belt Line Right-of-Way) to be subject to provisions of Section 21107.5 of the California Vehicle Code. BE IT FURTHER RESOLVED that said Council hereby authorizes the installation of stop signs on Sherman Street at the Alameda Belt Line Right-of-Way until such time as that roadway section becomes public. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 16th of May, 1989, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Withrow and President Corica - 4, NOES: Councilmember Thomas - 1.
