REJECTING ONE BID RECEIVED AS INCOMPLETE AND
AUTHORIZING NEGOTIATING IN THE OPEN MARKET
FOR REPLACEMENT OF VARIOUS TIDE CONTROL
GATES AT BAYVIEW AND WILLOW STREET WEIR
STRUCTURES PURSUANT TO SECTION 3-15 OF THE
CITY CHARTER, NO. P.W. 9 -88 -13
WHEREAS, the Alameda City Council, at the meeting of
September 6, 1988, directed the Acting Public Works Director to
proceed with a Request for Proposal for replacement of various
tide control gates at the Bayview Weir structure; and
WHEREAS, the City received only one bid in response to
the Request for Proposal and said bid was, on its face,
incomplete; and
WHEREAS, the structures and gates are in danger of
further deterioation, thereby causing a potentially hazardous
condition; and
WHEREAS, Section 3 -15 of the City Charter provides that
if great necessity or emergency requiries immediate action, the
Council may determine to effect such purchase in the open market.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the City reject the one bid submitted as
incomplete and pursuant to Section 3 -15 of the City Charter,
the Public Works Director is hereby authorized to negotiate in
the open market for equipment repair as described in the Request
for Proposal previously let.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 18th of July, 1989,
by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas,
Withrow, and President Corica - 5,
NOES: None.
ABSENT: None.
