APPROVING FINAL MAP FOR TRACT 4497
(HARBOR BAY VILLAGE FIVE)
AND PERMITTING RECORDING THEREOF
WHEREAS, Tract 4497 consists of three lots and is a
subdivision of a portion of Parcel 2, Parcel Map no. 4043 and
the lands designated as Parcel 1 and Parcels 6 through 11 in the
deed recorded July 1, 1986, Recorder's Series No 86-157054,
County of Alameda Records; and is the first of several final
maps proposed to be approved for Tract 5905.
WHEREAS, the Final Map is based on the tentative map for
Tract 5905, which was submitted by Harbor Bay Village Five
Associates, a partnership, subdivider, and approved by the City
Council on April 4, 1989; and
WHEREAS, the existing Final Environmental Impact Report
for Harbor Bay Isle certified by the Alameda City Council on
March 4, 1974, as previously supplemented by the City's General
Plan elements and their related environmental impact reports, and
the JKH traffic studies currently updated by the addendum dated
December 1988, with the inclusion of the information as requested
by Planning staff in the document labeled "Materials to be
Submitted by Applicant: Addendum, March 13, 1989," is adequate
to cover the current ultimate project description for Harbor Bay
Isle, including the Final Map for Tract 4497; and
WHEREAS, all public improvements associated with this map
will be constructed under the City of Alameda Community
Facilities District No. 1.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that pursuant to Section 11-3124 of the Alameda
Municipal Code, Final Map No 4497, is hereby approved and
permission given to subdivider to record same, based upon the
findings and subject to the conditions set forth in City of
Alameda Resolution No 11691 approving Vesting Tentative Map for
Tract 5905 Located in Village V of Harbor Bay Isle, adopted
April 4, 1989.
BE IT FURTHER RESOLVED, that the City accepts on behalf
of the public all easements and parcels of land offered for
dedication to the public for use in conformity with the terms of
the offers of dedication.
BE IT FURTHER RESOLVED that pursuant to Section
11-3112(f) of the Alameda Municipal Code the City Council finds
Final Map No. 4497 is consistent with the City's General Plan,
and pursuant to Section 11-3112(h) determines that discharge of
waste from the subdivision into the sewer system will not violate
regional water quality control regulations.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the first of August, 1989,
by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Thomas,
Withrow, and President Corica - 5.
NOES: None.
ABSENT: None.
