AUTHORIZING NEGOTIATING IN THE OPEN MARKET,
PURSUANT TO SECTION 3-15 OF THE CITY CHARTER,
FOR THE REPAIR OF PORTLAND CEMENT CONCRETE
SIDEWALK, CURB, GUTTER AND DRIVEWAY FOR THE
FISCAL YEAR ENDING JUNE 30, 1990, NO. P.W.
7-89-7
WHEREAS, on August 1, 1989, the Council of the City of
Alameda adopted the plans and specifications and called for bids
for the Repair of Portland Cement Concrete Sidewalk, Curb,
Gutter, and Driveway for the Fiscal Year Ending June 30, 1989,
No. P.W. 7-89-7; and
WHEREAS, bids were opened on September 1, 1989, and no
bids were received; and
WHEREAS, in accordance with Section 3-15 of the City
Charter, in case no bids are received, the Council may determine
that public work or improvements can be performed more
economically without contract in the open market; and
WHEREAS, it would be to the City's benefit to negotiate a
proposal for said project with several local contractors that
have been used in the past, who are very capable, and whose work
has been done to the City's satisfaction;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that pursuant to Section 3-15 of the City Charter the
Public Works Director is hereby authorized to negotiate in the
open market, without formal bidding procedures, for repair of
portland cement concrete sidewalk, curb, gutter, and driveway for
the fiscal year ending June 30, 1990.

Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 19th of September, 1989,
by the following vote to wit:
AYES: Councilmembers Camicia, Thomas, Withrow and
Acting President Arnerich 4.
NOES: None.
ABSENT: Mayor Corica - 1.
