AWARDING CONTRACT TO COLLISHAW CONSTRUCTION, INC. FOR THE
BASE BID FOR THE LUCIOUS BATEMAN DRIVING RANGE
LANDSCAPING AND FENCE INSTALLATION PROJECT, NO. P.W. 7-
89-12, AUTHORIZING EXECUTION THEREOF, AND AUTHORIZING
NEGOTIATION IN THE OPEN MARKET, PURSUANT TO SECTION 3-15
OF THE CITY CHARTER, FOR THE PURCHASE AND INSTALLATION
OF SOD
WHEREAS, the Council of the City of Alameda heretofore
published notice calling for bids for the Lucious Bateman Driving
Range Landscaping and Fence Installation Project in accordance with
Specifications No. P.W. 7-89-12 approved September 5, 1989; and
WHEREAS, in response to said notice a sealed bid was submitted
by Collishaw Construction, Inc. agreeing to perform said work in
accordance with said Specifications for the base bid sum of
$108,900; and
WHEREAS, said firm is a responsible bidder and its proposal
is the lowest and best bid received; and
WHEREAS, it has been determined that for a cost savings of
approximately $36,000 it would be to the City's advantage to
contract directly with a sod supplier for the add alternate
planting work; and
WHEREAS, in accordance with Section 3-15 of the City Charter,
the Council may determine that materials or supplies can be
purchased at a lower price in the open market and thereupon proceed
to purchase such materials or supplies in the open market; and
WHEREAS, said project consists of a base bid which includes
installation of galvanized chain link fencing at the boundary of
the driving range, an irrigation system, and an Add Alternate Bid
for planting sod; and
WHEREAS, the Planning Department, following the adoption
of the plans and specifications, determined that said project
requires a use permit; and
WHEREAS, the use permit was approved on September 25, 1989,
subject to the condition that the fence material be dark in color;
and
WHEREAS, Collishaw Construction, Inc., the low bidder,
was requested to provide a bid for providing black vinyl-coated
fence material in compliance with the condition of the use permit;
and
WHEREAS, complying with said condition will increase the
project cost by 60%; and
WHEREAS, an appeal was presented to the Council of the City
of Alameda on October 9, 1989, requesting the use permit condition
be overturned based on this cost information; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the base bid of Collishaw Construction, Inc. is hereby
accepted, the contract for the Lucious Bateman Driving Range
Landscaping and Fence Installation Project, No. P.W. 7-89-12 is
hereby awarded to said bidder, and the Mayor is hereby authorized
to execute, and the City Clerk to attest, said contract on behalf
of the City of Alameda.
BE IT FURTHER RESOLVED that the Public Works Director is
hereby authorized to negotiate in the open market, without formal
bidding procedures, for the purchase and installation of sod;
BE IT FURTHER RESOLVED that if the Council of the City of
Alameda does not grant the appeal of the use permit conditions,
negotiations will be resumed with the contractor to include vinyl
cladding of the fence material into said contract.
