Resolution 11852CITY OF ALAMEDA RESOLUTION NO. 11852 AUTHORIZING STAFF TO NEGOTIATE IN THE OPEN MARKET FOR PLANTING OF THE PORTOLA TRIANGLE DEMONSTRATION GARDEN WHEREAS, at its meeting of September 5, 1989, the Council of the City of Alameda approved an appropriation of $108,600 from the Dwelling Unit Tax account to fund the construction phase of developing the Portola Demonstration Garden; and WHEREAS, said construction phase which consists of grading the site, installation of a drainage system, irrigation lines and construction of pathways is underway and ready to begin the planting phase; and WHEREAS, costs for the 2.3 acre site are estimated at $12,500 and can best be handled by negotiating in the open market due to the following: 1. Planting of the meadow grass and wild flowers have to be done by mid November for proper germination. This restrictive schedule does not allow time for a formal bid process; 2. The plants have to be purchased from nurseries throughout California, will be arriving at various times of the planting season and must be stored by the contractor until the planting segment begins. This will take a great deal of coordination and it is essential that staff work with a local contractor; and 3. The coordination aspects, responsibilities, provisions and conditions of said project are very difficult to define in the scope of formal bid specifications; WHEREAS, in accordance with Section 3-15 of the City Charter, when great necessity or emergency requires immediate action, the Council may thereupon proceed to make such public work or improvements without contract in the open market; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that pursuant to Section 3-15 of the City Charter, the Recreation and Park Department Staff is hereby authorized to negotiate in the open market, without formal bidding procedures, for planting of the Portola Triangle Demonstration Garden. CITY ATTORNEY I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 17th day of October, 1989, by the following vote to wit: AYES: CounciImembers Arnerich, Thomas, Withrow and President Corica - 4.
