A RESOLUTION ORDERING CHANGES AND MODIFICATIONS
CITY OF ALAMEDA
Marina Village Assessment District 89 -1
RESOLVED, by the City Council (the "Council ") of the City of Alameda (the "City "),
County of Alameda, California, that
WHEREAS, on September 6, 1989, this Council adopted Resolution No. 11822, A
Resolution of Intention to Make Acquisitions and Improvements;
WHEREAS, the changes and modifications hereinafter ordered will not increase
the total amount of the assessment or the amount of any individual assessment, except
as requested in writing by the owners of the properties affected thereby, nor eliminate or
add any acquisitions or work which will substantially and adversely alter or affect the
benefits to be derived from the work and acquisitions;
WHEREAS, the public interest, convenience and necessity require the changes
and modifications hereinafter ordered;
WHEREAS, the Engineer of Work has filed with the City Clerk proposed revisions
to the Engineer's Report as preliminarily approved by this Council, to wit: a revised
estimate of costs, revisions in the assessment and a revised assessment diagram;
NOW, THEREFORE, IT IS ORDERED as follows:
1. That the total assessment in said proceedings as preliminarily approved be
decreased from $40,000,000 to $36,168,180.
2. That changes and modifications be made in individual assessments and the
estimate of costs and expenses of the acquisition and improvements as set forth in the
revised Engineer's Report on file with the City Clerk to which report reference is hereby
made for further particulars.
3. That the parcels excluded from the proposed boundaries of the assessment
district, as reflected by the map designated Amended Proposed Boundaries of said
assessment district, filed in the office of said Clerk as related to the map of the proposed
boundaries of said district filed in the office of the County Recorder of the County of
Alameda, be excluded from the boundaries of said district, and that said boundaries be
modified to conform with the boundaries as shown on said map designated Amended
Proposed Boundaries.
4. That the assessment diagram as preliminarily approved be modified to
conform with said filed revised assessment diagram.
5. That said amended boundary map is approved, and said Clerk shall cause said
amended boundary map to be filed in the office of the County Recorder no later than 10
days after adoption of this resolution, pursuant to Section 3113 of the Streets and
Highways Code, and said Recorder shall cross -index said amended boundary map by
reference to the book and page of Maps of Assessment Districts in which the original
boundary map was filed.
6. That said revised assessment diagram is approved, and said Clerk shall cause
said revised assessment diagram} to be recorded in the office of the Superintendent of
Streets of the City of Alameda and also to be filed in the office of the County Recorder.
7. That said Clerk and said Superintendent of Streets shall make said changes
and modifications in the total assessment and the individual assessments on the face of
the copies of the assessment roll on file in their respective offices.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 7th of November, 1989,
by the following vote to wit:
AYES: Councilmembers Arnerich, Cainicia, Thomas, Withrow
and President Corica - 5.
NOES: None.
ABSENT: None.
