RESOLUTION OF INTENTION TO VACATE A PORTION OF ALAMEDA
AVENUE, WEST OF OAK STREET, AND FIXING A DATE AND TIME
FOR PUBLIC HEARING.
WHEREAS, Alameda Unified School District proposes to make
modifications to Alameda High School which incorporates a portion
of Alameda Avenue, West of Oak Street; and
WHEREAS, the Public Works Department has no objection to
the proposed street vacation provided an appropriate utility
easement is reserved to contain all utilities and the Alameda
Unified School District mitigates the parking space loss; and
WHEREAS, a legal description describing the portions of
Alameda Avenue to be vacated is attached hereto as Exhibit A, and
a plat map is on file with the City Clerk;
WHEREAS, it is proposed that in return for the transfer
of said portion of Alameda Avenue property, (approximately 0.33
acre) as described in Exhibit A, that the Alameda Unified School
District provide an equivalent value to the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that;
(1) It is the intent of the City Council to vacate the
portion of Alameda Avenue described in Exhibit A.
(2) The vacation proceeding is conducted pursuant to the
provisions of the California Streets and Highways Code, Chapter 3,
Division 9, Part 3, (General Vacation Procedures) and particularly
Section 8320 thereof;
(2) A public hearing shall be set for 7:30 p.m. on
Wednesday, November 7, 1990, in the City Council Chambers, City
Hall, Alameda, the date being more than 15 days from the adoption
of this Resolution.
(4) Notice of the date, hour, and place of the public
hearing shall be published in the newspaper for at least two
successive weeks prior to the public hearing.
(5) Notices of vacation shall be posted along the
portion of Alameda Avenue to be vacated two weeks before the
hearing, in conformance with the procedures set forth in the
California Streets and Highways Code, Section 8323.
