Resolution 12205CITY OF ALAMEDA RESOLUTION NO 12205 APPROVING THE ALAMEDA COUNTY HAZARDOUS WASTE MANAGEMENT PLAN WHEREAS, the Alameda County Board of Supervisors, the fourteen cities in Alameda County and two sanitary districts have adopted a Joint Exercise of Powers Agreement, most recently amended February 13, 1990, creating the Alameda Waste Management Authority (Authority); and WHEREAS, the Joint Exercise of Powers Agreement provides that the Authority is responsible for preparation, adoption, amendment, administration, policy-making, budgeting, planning and enforcement of the Alameda County Hazardous Waste Management Plan, pursuant to California Code Section 66780.8 and California Health and Safety Code Sections 25135 through 25135.8, as those sections exist or as they may be amended from time to time; and WHEREAS, the Revised Final [Draft] Hazardous Waste Management Plan, dated August 1991, was prepared and transmitted by the ›- Authority to all concerned parties for review and comment; and u CC WHEREAS, a Mitigated Negative Declaration (SCH No. 91083112) 0 on the Plan was prepared and transmitted by the Authority to all concerned parties for review and comment; and WHEREAS, public hearings on said final draft Plan and Mitigated Negative Declaration were held August 28, September 25, October 23 and November 20, 1991, at which time all interested parties were provided the opportunity to be heard; and WHEREAS, said Plan was revised by incorporating the siting criteria and mitigation measures identified in the Mitigated Negative Declaration, thereby mitigating the environmental effects to a point where no significant effects would occur; and WHEREAS, the Mitigated Negative Declaration determines that there is no substantial evidence that the project may have a significant effect on the environment; and WHEREAS, all proposals for hazardous waste management facilities in Alameda County will have to comply with all aspects of the local environmental review process, pursuant to CEQA, and permitting requirements, including the preparation of a mitigation monitoring plan; and WHEREAS, an applicant that applies for a land-use permit for a hazardous waste facility in the City of Alameda must submit to the City a mitigation monitoring plan and provide a copy to the Alameda County Waste Management Authority; and WHEREAS, the Alameda County Waste Management Authority approved the Plan on December 18, 1991, and it is required that the Plan also be approved by a majority of the jurisdictions in the Authority containing a majority of residents; NOW, THEREFORE, BE IT RESOLVED that the Alameda City Council approves the Alameda County Hazardous Waste Management Plan dated December, 1991. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th day of February , 1992, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Lucas, Roth and President Withrow - 5.
