Resolution 12242CITY OF ALAMEDA RESOLUTION NO. 12242 URGING THE ALAMEDA COUNTY BOARD OF SUPERVISORS TO ADEQUATELY STAFF THE DISTRICT ATTORNEY ALAMEDA MUNICIPAL COURT BRANCH OFFICE AND OPPOSING PROPOSED BUDGET REDUCTIONS IN ALAMEDA COUNTY DISTRICT ATTORNEY'S OFFICE WHEREAS, the Alameda County District Attorney's office currently maintains a municipal court branch office in the City of Alameda; and WHEREAS, the proposed 1992-1993 Maintenance Of Effort Budget of the Alameda County District Attorney's office contains proposed program reduction targets of 22.6%, and includes closure of Branch Offices and the elimination of forty-eight deputy district attorneys; and WHEREAS, it is currently proposed by the District Attorney's office that the Alameda Municipal Court Branch Office would have to be eliminated in order to effect the 22.6% reduction; and WHEREAS, the branch office in Alameda County Courthouse is presently staffed by two Deputy District Attorneys and support staff who prosecute the City of Alameda misdemeanors; and WHEREAS, if the branch office of the Alameda District Attorney's Office is closed, the City of Alameda could be required to provide prosecutorial services for all misdemeanor crimes originating within Alameda; and WHEREAS, providing prosecutorial services could necessitate that Alameda either contract with the County to hire District Attorneys and staff at the estimated cost of $253,260.00 per year, or authorize the City Attorney's office to prosecute misdemeanors and budget for additional Deputy City Attorneys and sufficient staff in order to accept this function; and WHEREAS, in light of Alameda's current financial crisis, the additional expense that would be imposed by either of the above options would have a devastating impact on the City's ability to deliver vital city services; and WHEREAS, the proposed budget reductions are irresponsible and not in the best interest of the citizens of Alameda. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the Alameda County Board of Supervisors is hereby requested and urged to adequately fund and staff the Office of the District Attorney to ensure the continued maintenance of the Alameda Municipal Court Branch Offices. BE IT FURTHER RESOLVED by the City Council of the City of Alameda that the Alameda County Board of Supervisors is hereby requested and urged to seek a more responsible alternative to reducing county expenditures that do not dismantle the criminal justice system and pass any additional burden onto local jurisdictions. BE IT FURTHER RESOLVED that the City Clerk shall transmit a copy of this resolution to the Alameda County Board of Supervisors.
