Resolution 12307CITY OF ALAMEDA RESOLUTION NO. 12207 ACCEPTING GRANT OF EASEMENT FROM THE UNITED STATES OF AMERICA (DEPARTMENT OF THE NAVY) TO THE CITY OF ALAMEDA FOR MAIN STREET BIKE PATH WHEREAS, the Main Street Corridor Project provides for an off-street bicycle route along the easterly perimeter of the Alameda Naval Air Station from the end of Lincoln Avenue to Singleton Avenue; and WHEREAS, portions of the bicycle path will be located on Naval Air Station property; and WHEREAS, construction and usage of the bicycle.facilities requires the granting of an easement from the United States Navy to the City of Alameda; WHEREAS, on July 8, 1992, the City of Alameda obtained a Grant of Easement from the United States of America, acting through the Department of the Navy, a copy of which is on file in the Office of the City Clerk, that easement being subject to the following terms and conditions: 1. Construct and maintain the bike path facilities at the expense of the City. 2. The government reserves the right to make connections between the bicycle path and the Naval Air Station property. 3. The easement may be terminated upon failure of the City to comply with all terms or conditions of the Grant of Easement. 4. The easement shall not diminish the government's current rights of frontage and access. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda, that the City Council, by resolution, accept the Grant of Easement from the United States of America (U.S. Navy) to the City of Alameda. BE IT FURTHER RESOLVED that the Grant of Easement has a maturity date of fifty (50) years commencing July 8, 1992. BE IT FURTHER RESOLVED that the City Clerk record the Grant of Easement with the County of Alameda. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th day of August , 1992, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Lucas, Roth and President Withrow - 5.
