Resolution 12308CITY OF ALAMEDA RESOLUTION NO. 12308 ADOPTING THE LAND USE ANALYSIS PROGRAM, A COMPONENT OF THE CONGESTION MANAGEMENT PROGRAM (CMP) WHEREAS, Chapter 2.6, Section 65089 of the California Government Code requires congestion management programs to contain a program to analyze the impacts of land use decisions made by local jurisdictions on regional transportation systems; and WHEREAS, the October 24, 1991 Alameda County Congestion Management Program (CMP) requires local jurisdictions to adopt a land use program to analyze the impacts of land use decisions on the regional transportation system; and WHEREAS, the Alameda County Congestion Management Agency Board on July 23, 1992 adopted the Good Faith Effort definition for the land use analysis program amending the initial adoption date of August 1, 1992 to October 1, 1992; and WHEREAS, the failure to comply with the provisions of the CMP law would put transportation revenues such as local fuel subventions pursuant to Proposition 111 and State Transportation Improvements Program funds at risk; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the City Council adopts the Land Use Analysis - Program, in conformance with Exhibit A, attached hereto, and authorizes the City Manager or his designee to approve amendments to the program; and BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the Alameda County Congestion Management Agency. GUIDELINES Alameda County CMA Tier I, (GPA) Land Use Analysis Program June 26, 1992 EXHIBIT Page 1 Background The October 24, 1991 Alameda County Congestion Management Program (CMP), requires that local jurisdictions conform with the CMP Land Use Analysis Program. The Land Use Analysis Program has two tiers. Tier I requires jurisdictions to report general plan amendment (GPA) applications to the CMA, and Tier II is an annual land use update requirement. Guidelines for conforming with the Tier I Program are presented in this document. Refer to the CMA document entitled, Tier 11, GPA Land Use Analysis Program for the requirements and guidelines of the Tier II Program. Conformance Requirements To conform with the Tier I Program, local jurisdictions are required to do the following by the indicated dates: 1. Adopt a GPA Land Use Analysis Program which is consistent with the requirements set forth in this document by August 1, 1992. 2. Send the CMA relevant data (see Data Requirements below) for GPA applications estimated to generate 100 or more additional PM peak hour trips. The CMA will model the subject GPA in isolation (not including other GPA applications) on the CMP roadway system using the Countywide Travel Demand Model. GPA applications and relevant data should be provided to the CIV1A within the initial scoping period specified by CEQA. 3. Analyze the impact and identify mitigation measures of the subject GPA on the CMP roadway system using CMA travel demand modelling data The modelling data, consisting of travel speeds, traffic volumes, and Volume to Capacity ratios, will be sent to the jurisdictions within fourteen (14) calendar days of the CMA receiving a fully completed,•and acceptable GPA application. 4. Incorporate analyses and mitigation measures (in 3 above) into the environmental documentation prepared for the subject GPA, and submit document to the CMA for review and comment. The maximum review period for environmental documentation is 45 days for Environmental Impact Reports, and 21 days for Negative Declarations, but may be extended by agreement with the local jurisdiction. 5. Notify the CMA within fourteen (14) calendar days after subject GPA has been approved. The CMA will update the Countywide Travel Demand Model land use database. Data Requirements Local jurisdictions must complete the GPA summary data sheet (see Attachment B), and submit the subject GPA application document to the CMA (in response to Conformance Requirement 2 above). The data required by the CMA includes: Page 2 * Description and map of the precise location of the project. * Location of proposed street access, and relationship to CMP roadway system. * Description of types of uses in the project (e.g. single family dwelling units, low income senior housing units, etc.). * Quantification of the uses, such as the number of dwelling units, square feet of commercial use, number of jobs, etc. * Traffic studies prepared for the project, if any. * Expected occupancy date (year). If a multi -phase project, then the expected occupancy date for each phase. * Degree of completion (e.g. occupancy) by the CIP target year (year 2000).' Use of CMA Approved Subarea Models A jurisdiction may use a CMA approved subarea model to evaluate the impact of a subject GPA on the CMP roadway system. A CMA approved subarea model is defined in the Alameda County CMA Subarea Modelling Policy. If a jurisdiction elects to use a CMA approved subarea model they must (1) notify the CMA, through written communication, that they intend to use the subarea model for the Tier I, Land Use Analysis Program, and (2) complete Conformance Requirements 1 to 5, listed above. Note, for Conformance Requirement 3, unless the jurisdiction requests that the CMA test the subject GPA and provide the modelling data to the jurisdiction, the jurisdiction will be responsible for modelling runs and data to be provided to the CMA within fourteen (14) days. Exceptions A GPA (that is estimated to generate 100 or more additional PM peak hour trips) is exempt from the Tier 1, GPA Land Use Analysis Program if 1. It is adopted before August 1, 1992, and /or 2. A notice of Preparation for a Draft Environmental Impact Report or Negative Declaration for the subject GPA has been distributed for public comment before August 1, 1992. As stated in the CMP legislation (Section 65089.3 (c) (5)), "traffic generated by the provision of low and very low income housing" shall be excluded from the determination of conformance with LOS standards. Therefore, vehicle trips generated by low or very low income housing may be discounted in determining the LOS on the CMP roadway system. The method used and the discretion to subtract these trips will be left to the jurisdictions. However, if a jurisdiction subtracts any trips generated from prospective low or very low income housing in the calculation of L057, it must provide written communication to the CMA describing the type of housing, and the methodology used to identify and subtract these trips. t A process to ensure analysis of GPA impacts beyond the level of completion by the target year will be developed during 1992 -1993. TIER I, GPA Land Use Analysis Program Page 2 - June 26, 1992 Non - Conformance Local jurisdictions that fail to meet any of the conformance, schedule or data requirements presented in this document may found in non - conformance with CMP requirements. Pursuant to a finding of non - conformance by the CMA, and if a local jurisdiction does not take the necessary steps to conform within ninety (90) days, the State Controller will withhold Proposition 111 gas tax subventions to that jurisdiction. TIER I, GPA Land Use Analysis Program Page 3 - lune 26, 1992 Page 4 GPA SUMMARY DATA FORM Tier 1, GPA Land Use Analysis Program June 26, 1992 To conform to the Alameda County Congestion Management Agency's Tier I, GPA Land Use Analysis Program requirement, a jurisdiction must complete and return this Form, and a copy of the subject GPA application document to the CMA. If required, an ASCII file format of the data may be requested by the CMA. This Form is not complete unless all questions are answered (attach additional pages, if required): 1. Project description, including location of proposed street access and relationship to CMP roadway system. 2. Attach a study area map to this Form. 3. Describe the types of uses to be included in the project (e.g. single family dwellings, low income senior housing units, etc.). 4. Will any trips generated by low or very low income housing be excluded in determining if this GPA generates 100 or more additional PM peak hour trips? Yes No_. If yes, attach supporting documentation describing the low or very low income housing, and the methodology used to identify and subtract those trips from total trips. 5. Have any traffic studies been prepared for this project? Yes_ No_. If yes, attach to this Form. 6. What is the expected occupancy date (year) for this project? If a multi -phase project, then the expected occupancy date for each phase 7. What will be the per cent completion of the project by the year 2000 (e.g. 10 %, 50 %, etc.)? 8. Name of Jurisdiction: Contact Person and Phone Number: Date of Submittal: Page 5 GUIDELINES Alameda County CMA Tier II, Land Use Analysis Program June 26, 1992 Background The October 24, 1991 Alameda County Congestion Management Program (CMP), requires that local jurisdictions conform with the CMP Land Use Analysis Program. The Land Use Analysis Program is a two tiered system. Tier I requires jurisdictions to report GPA applications to the CMA and Tier H is an annual land use update requirement. The guidelines for conforming with the Tier I program are presented in the CMA document entitled, Tier I, GPA Land Use Analysis Program. The guidelines for the Tier II Program are presented below. Program Description Annually local jurisdictions will update their forecast of land use projections for the CMP target year. These projections will consider market trends as well as GPAs that have been approved in the past year. The CMP target year is the last year covered in the seven year Capital °Improvement Program (CIP) for a given CMP. For the 1991 CMP, the target year is 1998. Since a 1998 land use database is not available, the CMA will use year 2000 forecasts as the target year forecasts for the first CMP cycle. For the first CMP year (1992), due to the time needed by local jurisdictions to set up adequate data collection systems, there will only be one data submittal. The Countywide Travel Demand Model's land use database will be updated accordingly. Model runs depicting operating conditions on the CMP roadway system will be generated by the CMA, and distributed to the local jurisdictions for analysis. Data Submittal Schedule To conform with the Tier II Program, local jurisdictions are required to adhere to the following schedule: 1. Adopt a Tier II, I and Use Analysis Program which is consistent with the requirements set forth in this document by August 1, 1992. 2. Submit year 2000 and 2010 forecast land use projections no later than February 1, 1993. 3. In future CMP years, submit year 2000 and 2010 forecast land use projections annually, no later than August 1 of each year (beginning in 1994). The CMA will incorporate the land use changes into the Countywide Travel Demand Model's land use database. By September 1 of each year, the CMA will prepare a countywide model run of operating conditions on the CMP roadway system using the revised land use database. The data from these model runs (consisting of traffic volumes, speeds, and Volume to Capacity ratios), will be distributed to the local jurisdictions to be used in understanding the compounded effect of all projected land use changes on the roadway system. Page 6 Data Requirements Annual land use updates must be transmitted to the CMA using the attached Land Use Database Update Form. If significant updates are included, the CMA may request that this data be provided in an ASCII file format. Land use updates should include all forecast land use projections anticipated to occur in addition to GPAs that have been approved in the last year. Adopted GPAs submitted to the CMA in connection with the Tier I, GPA Land Use Analysis Program, need not be resubmitted. If a jurisdiction does not have any forecast land use projections to submit to the CMA, they must indicate that on the Land Use Database Update Form. If a local jurisdiction fails to submit a Land Use Database Update Form by the August deadline, they may be found in non- conformance with the CMP. Non - Conformance Local jurisdictions that fail to meet any of the conformance, schedule or data requirements presented in this document may be found in non - conformance with CMP requirements.
