Resolution 12345CITY OF ALAMEDA RESOLUTION NO. 12345 AUTHORIZING AN APPROPRIATION FOR THE CITY'S OBLIGATION UNDER THE COOPERATION AGREEMENT BETWEEN THE CITY OF ALAMEDA AND THE COMMUNITY IMPROVEMENT COMMISSION WHEREAS, the City Council of the City of Alameda, acting pursuant to the provisions of the California Community Redevelopment Law (Health and Safety Code section 33000 et seq.), has activated the Community Improvement Commission of the City of Alameda (the HCommissionu) and has declared itself to constitute the Commission by Ordinance No. 2103, adopted on August 4, 1982; and WHEREAS, pursuant to the Community Redevelopment Law, the Commission is performing a public function of the City and may have access to services and facilities of the City; and WHEREAS, the City and the Commission have entered into alq ;E Cooperation Agreement in order to _CD (1) Set forth activities, services and facilities which the City will render for and make available to the Commission in co furtherance of the activities and functions of the Commission under the Community Redevelopment Law; and .271 (2) Provide that the Commission will reimburse the City for actions undertaken and costs and expenses incurred by it, for and on behalf of the Commission; and WHEREAS, pursuant to Community Redevelopment Law (CRL) the Community Improvement Commission is required to allocate, prior to May 10, 1993, $443,375.89 to the County Auditor for deposit into the Educational Revenue Augmentation Fund; and WHEREAS, pursuant to CRL, section 33683, allocation to the Educational Revenue Augmentation Fund and payments to the legislative body are not counted in determining the total amount of tax increment revenues received by the Commission over the life of the plan for the West End Community Improvement Project or the plan for the Business and Waterfront Improvement Project. NOW, THEREFORE, the City Council hereby appropriates, and directs and authorizes the Finance Director of the City of Alameda to establish a supplemental budget encumbrance for the City's obligation under the Cooperation Agreement in the amount of $143,400 for FY 1992-93. BE IT FURTHER RESOLVED that the City Council hereby directs the Finance Director to advance the funds to the Community Improvement Commission in sufficient time to make the required May 10, 1992 allocation to the Educational Revenue Augmentation Fund. BE IT FURTHER RESOLVED that the City Council directs the City Manager to report to the County Auditor by March 1, 1993, that the Community Improvement Commission intends, barring circumstances requiring consideration by the Community Improvement Commission and Council (such as litigation challenging SB 844/617), to make the full allocation by May 10, 1993.
