Resolution 12394CITY OF ALAMEDA RESOLUTION NO. 12394 REQUESTING AN INCREASE IN BAIL SCHEDULE FOR CERTAIN VEHICLE CODE VIOLATIONS WHEREAS, unsafe traffic conditions exist when motor vehicles pass other motor vehicles on the right side of the roadway, and/or in bicycle lanes; and WHEREAS, the City of Alameda urges appropriate action be taken to request an increase in the bail schedule for violations of California Vehicle Code Sections 21754 (Improper Passing On Right), 21755 (Unsafe Passing On Right Shoulder), and 21209 (Motor Vehicles and Motorized Bicycles in Bicycle Lanes); and WHEREAS, California Penal Code Section 1269B authorizes the Judicial Council of California to establish penalties for Vehicle Code infractions; and 0 ---- WHEREAS, the Uniform Bail and Penalty Schedule cc cn 5O establishes a bail of $104.00 for the subject code violations (21754VC, 21755VC, and 21209VC); and T3 WHEREAS, only the Judicial Council can change the bail 0 schedule. CL CL NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that said Judicial Council hereby requests, by resolution, that the Judicial Council increase the bail for the subject Vehicle Code violation from $104.00 to $204.00. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to forward a certified copy of this resolution to the Judicial Council of California, Administrative Office of the Courts, 801 K Street, Suite 1800, Sacramento, California 95814.
