AUTHORIZING APPLICATION FOR REGIONAL MEASURE 1
"THREE PERCENT RESERVE" FUNDS FOR OPERATING SUBSIDY
FOR THE ALAMEDA OAKLAND FERRY SERVICE
WHEREAS, Regional Measure 1 (November 1988) created new
revenues, among which are the "Three Percent Reserve" funds, for
allocation by MTC; and
WHEREAS, the "Three Percent Reserve" can be used to fund
planning, operating, and capital projects which are designed to
reduce vehicular traffic of the bridges; and
WHEREAS, the public entities are eligible applicants; and
WHEREAS, the City of Alameda, in conjunction with the
Port of Oakland, operates the Alameda/Oakland Ferry Service (AOFS);
and
WHEREAS, the City identifies the AOFS and its subsequent
need for operational subsidy in its Budget as CIP 89-14;
NOW, THEREFORE, be it resolved that the City Council of
the City of Alameda does hereby approve the AOFS Project and 2
authorizes the City Manager to apply for Regional Measure 1 "Three 2<1
Percent Reserve" funds for operating subsidy for the AOFS and to
enter into all agreements necessary to secure these funds.

A RESOLUTION OF INTENTION TO FORM AN
ASSESSMENT DISTRICT AND
ORDERING PUBLIC HEARINGS THEREON
CITY OF ALAMEDA
BAY FARM ISLAND DIKE MAINTENANCE ASSESSMENT DISTRICT NO. 93-1
RESOLVED, by the City Council (the "Council") of the City of
Alameda (the "City"), County of Alameda, California that
1. Intention. This Council declares its intention to order
formation of an assessment district, designated the "City of
Alameda Bay Farm Island Dike Maintenance Assessment District No.
93-1" (the "District"), to levy and collect assessments and to
issue bonds or notes, pursuant to the Alameda Maintenance Procedure
Code, Article V of Title III of the Alameda Municipal Code.
2. Improvements Described. The public improvements to be
accomplished by the City through the District consist, generally,
of the repair of major failures in the Bay Farm Island dikes
including shoreline stabilization, rip rap, bulkheads and all work
necessary and convenient to the accomplishment thereof.
3. District Boundaries. The District is located within the
City and is generally the area known as Bay Farm Island. The
proposed boundaries of the District are hereby described as shown
on a map thereof on file in the office of the City Clerk (the
"Diagram"), which by a boundary line indicates the extent of the
territory to be included in the District and which Diagram shall
govern for all further purposes of this Council's proceedings under
the Act for the District and to which reference is hereby made for
further particulars.
4. Engineer's Report Preliminarily Approved. Pursuant to
Resolution No. 12376, adopted by this Council on April 6, 1993, a
report as required by the Act (the "Engineer's Report") has been
prepared and filed with the City Clerk, duly considered by this
Council and is hereby deemed sufficient and is preliminarily
approved and shall stand for purposes of this Council's further
proceedings under the Act for the District. Reference is hereby
made to the Engineer's Report for further particulars, including
the proposed assessments on assessable lots and parcels of land
within the District. The Engineer's Report shall be available for
public inspection at the office of the City Clerk during ordinary
business hours of the City.
5. Public Hearings Ordered. Pursuant to the Act, this
Council hereby orders two public hearings to be held before this
Council in its City Council Chambers, City Hall, 2263 Santa Clara
Avenue, Alameda, California, as follows:
(a.) The first hearing shall be held July 6, 1993, at the
hour of 7:30 o'clock p.m. for the purpose of allowing public
testimony regarding the formation of the District and the levy of
the assessments; provided, however, that at said first hearing, no
final action shall be taken to create the District; and
(b.) The second hearing shall be held on July 20, 1993, at
the hour of 7:30 o'clock p.m. for the purposes of this Council's
determination whether the public interest, convenience and
necessity require the formation of the District, the ordering of
improvements and the levy and collection of assessments for the
acquisition, construction and maintenance of the improvements and
the issuance of bonds to finance all or a portion of the costs of
acquisition and construction thereof.
6. Notice of Hearings. The City Clerk is hereby authorized
and directed to cause notice of the hearings to be given in each of
the following ways pursuant to the Act, to wit:
(a.) By publication of this resolution, one time, at least
ten (10) days before the date of the first hearing specified in
Section 5(a) hereof in a newspaper of general circulation within
the City; and
(b.) By mailing, fist class mail, postage prepaid, at least
forty-five (45) days before the date of the second hearing
specified in Section 5(b) hereof, written notice of hearings to
each owner of property proposed to be assessed in the District at
their addresses as they appear in the latest equalized assessment
roll of the County of Alameda or the State Board of Equalization,
as the case may be, or as known to the City Clerk, or to both if
not the same. The mailed notice shall include the amount of the
proposed assessment for the parcel, a statement that the property
owner may protest the proposed assessment, the address to which
protests may be sent and a statement that a majority protest will
cause the abandonment of the proceedings for formation.
