A RESOLUTION ORDERING CHANGES AND MODIFICATIONS TO
HARBOR BAY BUSINESS PARK ASSESSMENT DISTRICT 92-1
RESOLVED by the City Council (the "Council") of the City
of Alameda (the "City"), County of Alameda, State of California,
that
WHEREAS, pursuant to a Resolution of Intention to Make
Changes and Modifications No. 12464, adopted by this Council on
October 19, 1993, notice has been duly given of the intention of
this Council to make changes and modifications in the proceedings
under and pursuant to Resolution No. 12197, adopted by this Council
on February 4, 1992; and
WHEREAS, all persons desiring to be heard were given an
opportunity to be heard, and all matters and things pertaining to
said changes and modifications were fully heard and considered by
this Council;
NOW, THEREFORE, IT IS ORDERED that:
1. All protests and objections be, and they are hereby,
overruled.
2. The changes and modifications in the proceedings
under tha Resolution of Intention be made and had, all as more
particulary described and ;et forth in Exhibit A attached hereto
and hereby made a part hereof.
EXHIBIT A
The proceedings of the City of Alameda in and for the Harbor
Bay Business Park Assessment District 92-1 shall be changed and
modified as follows:
(1) To add to Exhibit A, the Description of Work, attached to
Resolution of Intention No. 12197 adopted on February 4, 1992,
Section 8 reading as follows:
8. The acquisition by the City for public purposes,
including but not limited to, public park and play field facilities
and for sale and/or lease to other governmental entities,
including, but not limited to, the University of California, or any
agency, department or campus thereof, of that certain parcel of
land consisting of approximately 10.28 acres and identified as
Alameda County Assessor Parcel No. 74-1339-32 and construction of
public improvements, together with all costs related to said
acquisition and construction and sale and/or lease including
required costs of clearing liens, title insurance, appraisals and
all required studies, reports and related documentation; and
(2) To make conforming changes in and to the Engineer's
Report in and for the proceedings for the Assessment District to
provide that funds specified therein shall be reallocated to the
revised uses provided as follows:
The Estimate of Costs, Page 8, shall be modified to show
$400,000.00 as available for the Cross-Airport Road and
$2,200,000.00 as available for the acquisition of property for
soccer fields and a research facility.
The Description of Work, Page 10, shall be modified by the
addition thereto of Section 8 as set forth in Section (1) of this
Exhibit A.
The Method of Assessment, Page 12, shall be modified by the
addition of the following paragraph:
"7A. The cost of purchasing property for the soccer fields
and research facility shall be assessed on the basis of parcel area
to all undeveloped parcels in the assessment district."
These changes and modifications shall not change the amount or
method of assessment for any of the assessments within Assessment
District 92-1, including the assessment spread calculations,
boundaries or assessment diagram.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in special meeting assembled on the 30th day of
November , 1993, by the following vote to wit:
