AUTHORIZING OPEN MARKET PURCHASE OF A
100 FOOT AERIAL LADDER TRUCK FOR THE FIRE DEPARTMENT
WHEREAS, the Alameda Fire Department, for twenty four years,
has operated two aerial ladder trucks as first line apparatus; and
WHEREAS, a third truck has operated on a reserve status; and
WHEREAS, on March 3, 1994, all of the Alameda Fire
Department's aerial ladders were tested for aerial lift devise
certification; and
WHEREAS, two of the aerial ladder fire trucks did not meet the
new Cal. O.S.H.A. and N.F.P.A. standards, therefore, certification
was not possible; and
WHEREAS, these aerial ladder trucks are not economically
feasible to repair and have certified; and

WHEREAS, an emergency situation exists when the only remaining
aerial ladder truck is out of service for repairs, maintenance,
training or on another call since there is no aerial ladder truck
to replace it;
WHEREAS, in accordance with Section 3-15 of the City Charter,
the Council may, by four (4) votes, determine that great necessity
requires immediate action and thereupon proceed to purchase such
equipment in the open market; and
WHEREAS, great necessity exists to acquire a 100 foot aerial
ladder truck, enabling the City of Alameda to maintain a high level
of emergency service;
WHEREAS, there are sufficient funds available for the purchase
of a 100 foot aerial ladder truck; and
WHEREAS, the estimated cost of a 100 foot aerial ladder truck
is $450,000; and
WHEREAS, it is anticipated that the City will be issuing
certificates of participation for capital purchases for the 94-95
fiscal year; and
WHEREAS, the annual pro-rata debt service for this equipment
is estimated to be $50,000 per year; and
WHEREAS, budget allocations for the purchase will be included
in subsequent budgets;

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda, by four (4) votes, authorizes the Fire Chief and/or his
authorized representative to enter into an open market purchase
agreement for the design, construction and purchase of a 100 foot
aerial ladder fire truck at the all inclusive cost of $450,000
without formal bidding procedures;
BE IT FURTHER RESOLVED that the City Council of the City of
Alameda hereby authorizes an additional six percent (6%)
contingency, to be controlled by the City, for an additional
appropriation of $27,000.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 19th day of
