ACCEPTING GIFTS OF REAL PROPERTY AND INCOME
UNDER THE WILL OF JEANETTE B. MEYERS
WHEREAS, in 1972 the City of Alameda accepted the devise of a
one-third interest in certain real property commonly designated as
2021 Alameda Avenue, Alameda, California to the City of Alameda
from the estate of Edith Meyers; and
WHEREAS, said devise required that the property be used as a
neighborhood park; and
WHEREAS, under the last will and testament of Jeanette B.
Meyers there was devised to the City of Alameda the remainder of
that certain real property commonly designated as 2021 Alameda
Avenue, Alameda, California; and
WHEREAS, said will and testament required that the property be
used as a neighborhood park; and
WHEREAS, codicils to said will and testament executed by
Jeanette B. Meyers change the terms of the gift of real property
and require the property to be used for the auxiliary uses of the
Alameda Historical Society Museum; and
WHEREAS, said will and testament requires that the City
accept, within six months of Jeanette B. Meyers' death, the gift of
real property subject to all terms and conditions set forth in said
will and testament; and
WHEREAS, said will and testament also provided for the City to
receive certain income to be used for the capital and maintenance
expenses of the property;
WHEREAS, the City intends to use the real property in a manner
consistent with the terms of the trust of Edith Meyers and the will
and testament of Jeanette B. Meyers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL that
pursuant to Section 22-10 of the City Charter, the City Council
does hereby accept the gifts of real property, commonly known as
2021 Alameda Avenue, said acceptance being in full accordance with
all terms and conditions thereof; and
BE IT FURTHER RESOLVED that the Mayor be and he hereby is
authorized to consent to the acceptance of any conveyance
evidencing such gift, for all purposes including recordation
thereof; and
BE IT FURTHER RESOLVED that this resolution shall be deemed in
compliance with the provisions of said will and testament which
require acceptance of the gift of real property.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd day of
May , 1994, by the following vote to wit:

Councilmembers Appezzato, Arnerich, Roth and
President Withrow - 4.
NOES: None.
ABSENT: None.
ABSTENTIONS: Councilmember Lucas - 1.
