OPPOSING ASSEMBLY BILL 51 WHICH AMENDS
HOUSING ELEMENT REQUIREMENTS FOR GENERAL PLANS
WHEREAS, Assembly Bill 51 (Costa) would greatly reduce
local control over the development of housing through changes in
requirements for the Housing Elements of General Plans; and
WHEREAS, Assembly Bill 51 (Costa) would place undue
burdens upon local governments in the event of litigation regarding
the adequacy of Housing Elements; and
WHEREAS, Assembly Bill 51 (Costa) would virtually mandate
local approval of below market rate housing developments,
regardless of General Plan designations; and
WHEREAS, the City of Alameda has a Housing Element which
has been found by the State Department of Housing and Community
Development to be in compliance with the present Housing Element
law; and
WHEREAS, the City of Alameda would support changes to the
Housing Element law which would make it more realistic, effective,
and usable by local governments; and
WHEREAS, the League of California Cities has requested
letters of opposition to Assembly Bill 51 (Costa);
NOW, THEREFORE, BE IT RESOLVED that the City of Alameda
hereby opposes the passage of Assembly Bill 51 (Costa) by the
Legislature.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to forward a certified copy of this resolution to the
President pro tempore of the Senate, the Speaker of the Assembly,
Assemblyman Costa, the Governor, Senator Nicholas Petris,
Assemblywoman Barbara Lee, and the Senate Local Government
Committee.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 19th day of
July , 1994, by the following vote to wit:
AYES: Councilmembers Appezzato, Arnerich, Lucas,
Roth and President Withrow - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
