AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
OPEN MARKET CONTRACT FOR EMERGENCY SANITARY SEWER REPAIR
WHEREAS, the City of Alameda is responsible for
maintaining the sanitary sewer systems; and
WHEREAS, on December 8, 1994, the City experienced a
sanitary sewer backup and overflow at the south end of Bay Street
at the South Shore Lagoon; and
WHEREAS, subsequent investigation by the City's Public
Works Division revealed approximately 2,000 feet of sanitary sewer
lines needing immediate repair; and
WHEREAS, in accordance with Section 3-15 of the City
Charter, the Council allay, by four (4) votes, determine the great
necessity requires immediate action and thereupon proceed to
acquire a contractor in the open market to make the necessary
repairs; and
WHEREAS, great necessity exists to repair approximately
2,000 feet of sanitary sewers; and
WHEREAS, there are sufficient funds available to finance
the proposed project; and
WHEREAS, the estimated cost of the project is $310,000.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda, that pursuant to Section 3-15 of the City Charter, the
City Council hereby authorizes the City Manager and/or his
authorized representatives to enter into an open market contract
for emergency sanitary sewer repair at the all-inclusive cost of
$310,000, without formal bidding procedures.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 7th day of
February , 1995, by the following vote to wit:
AYES: Councilmembers Arnerich, DeWitt, Lucas,
Mannix and President Appezzato 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
