ESTABLISHING A PERMANENT PUBLIC ACCESS EASEMENT WITHIN THE
CITY-OWNED DOOLITTLE LANDFILL SITE AND AT THE NORTH END OF
VETERANS COURT
WHEREAS, pursuant to the California Government Code Sections
66600 through 66661, the City on March 20, 1987, filed
Application No. M87-8 for a San Francisco Bay Conservation and
Development Commission (BCDC) administrative permit; and
WHEREAS, City of Alameda Resolution No. 11376, approved by
the City Council on January 5, 1988, established a permanent
public access easement within the City-owned Doolittle Landfill
Site as conditioned under said permit; and
WHEREAS, said Permit No. M87-8 has been amended three times
through October 11, 1994; and
WHEREAS, BCDC has submitted an Agreement Imposing Public
Access Restrictions on the Doolittle Landfill Site and Veterans
Court as amended through Amendment No.3 of BCDC Permit No. M87-8;
and
WHEREAS, said agreement supersedes all prior public access
easement agreements; and
WHEREAS, it is in the best interests of the City to enter
into said Agreement;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the form of agreement imposing restrictions in
perpetuity for public access uses, including walking, sitting,
viewing, and related purposes, on the property referred to in the
foregoing recitals, and its terms, covenants and conditions be
and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Alameda
is hereby authorized and directed to execute on behalf of the
City of Alameda that certain Agreement Imposing Restrictions on
Use of Real Property between the City of Alameda and the San
Francisco Bay Conservation and Development Commission.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 20th day of

AYES: Councilmembers DeWitt, Lucas, Nannix and
President Appezzato - 4.
NOES: ' None.
ABSENT: Councilman Arnerich - 1.
ABSTENTIONS: None.
