UPHOLDING THE PLANNING BOARD'S DENIAL OF
VARIANCE V -95 -2 RELATING TO CONSTRUCTION OF A 740 SQUARE FOOT,
ONE STORY EXPANSION TO THE REAR OF AN EXISTING CHURCH TO ENCROACH
TEN FEET (10') INTO THE REQUIRED REAR YARD AT 1531 SIXTH STREET
WHEREAS, an application was filed on April 11, 1995 by Alameda
Community Church a Variance, V -95 -6 for a one -story addition to the
rear of the church. A Variance is required because the addition
extends to within 10 feet of the rear property line instead of the
required 20 feet; and
WHEREAS, the applications were accepted as complete on May 24,
1995; and
WHEREAS, the subject parcels are designated as Medium Density
Residential on the General Plan Diagram; and
WHEREAS, the Planning Board held a public hearing on June 26,
1995 to consider Variance, V -95 -6, and upon due consideration
denied the applications; and
WHEREAS, an appeal was made on June 28, 1995 by Daniel Weller
for the Alameda Community Church to the City Council of the denial
by the Planning Board of the Variance; and
WHEREAS, the City Council held a public hearing on this appeal
on August 15, 1995, and has examined pertinent maps, drawings and
documents; and
WHEREAS, the City Council finds that the proposal is
Categorically Exempt under CEQA Guidelines, Section 15301(e)(1)
additions to existing facilities;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Alameda adopts the findings of the Planning Board contained
in Planning Board Resolution, PB- 95 -25, and upholds the Planning
Board denial of Variance, V -95 -6, based on the adopted findings.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 15th day of
August , 1995, by the following vote to wit:

Councilmembers DeWitt, Lucas, Mannix and
President Appezzato - 4.
NOES: Councilman Arnerich 1.
