Resolution 12698CITY OF ALAMEDA RESOLUTION NO. 12698 AUTHORIZING SUBMITTAL OF APPLICATION AND EXECUTION OF CONTRACT FOR 1996-97 FERRY MARKETING FUND WHEREAS, the October, 1989 Loma Prieta earthquake resulted in the destruction of transportation infrastructure which severely limited access of the City of Alameda to San Francisco; and WHEREAS, Caltrans has since that time provided express corridor funding to the City of Alameda for marketing the Alameda/Oakland ferry services; and WHEREAS, the City has entered into agreements with Caltrans on an annual basis to secure this funding; and WHEREAS, the existing agreement has expired and a new agreement needs to be executed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the City Manager or his designee is hereby r--7- authorized to submit and execute a contract with Caltrans, in the form substantially similar to the proposed contract on file in the Office of the City Clerk, for Cypress Corridor Funding for marketing the Alameda/Oakland ferry service. Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12699 AUTHORIZING APPLICATIONS FOR TRANSPORTATION ENHANCEMENT ACTIVITIES (TEA) GRANTS FOR ATLANTIC AVENUEJJOW EMISSION VEHICLE GREEN BELT, MAIN STREET LINEAR PARK AND SHERMAN STREET IMPROVEMENTS WHEREAS, the United States Congress has enacted the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA), which is to make available over $200 million in federal dollars over a six-year period as funds to the California Department of Transportation for transportation enhancement activities; and WHEREAS, the Department of Transportation has estab- lished the procedures and criteria for reviewing proposals and, along with the Regional Transportation Agencies, will submit to the California Transportation Commission a list of recommended projects from which the recipients will be selected; and WHEREAS, said procedures and criteria established by the California Department of Transportation call for the approval of an application by the applicant's governing body before submission of said application to the California Transportation Commission; and WHEREAS, the applications contain assurances with which the applicant must comply; and WHEREAS, the applicant, if selected, will enter into agreements with the State of California to carry out the trans- portation enhancement activities projects. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that said Council hereby authorizes staff to file an application for the Transportation Enhancement Activities Program for consideration for funding for the Atlantic Avenue Low Emission Vehicle Green Belt and Main Street Linear Park. BE IT FURTHER RESOLVED that said Council hereby guarantees the 20% local matching funds, amounting to $178,466 for the Atlantic Avenue Low Emission Vehicle Green Belt, and $140,000 for the Main Street Linear Park and $150„000 for the Sherman Street Improvements. BE IT FURTHER RESOLVED that said Council certifies that the City of Alameda will make adequate provisions for operation and maintenance of the projects; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to act as agent of the City of Alameda to conduct all negotiations, execute and submit all documents including, but not limited to, the applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned projects. Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12700, AUTHORIZING SUBMITTAL OF A TRANSIT CAPITAL IMPROVEMENT (TCI) PROJECT APPLICATION FOR THE ACQUISITION OF A REPLACEMENT FERRY VESSEL FOR THE ALAMEDA/OAKLAND FERRY SERVICE WHEREAS, the City Attorney had found that the City has the financial and institutional ability to implement a project for the acquisition of a replacement ferry vessel and that the City is empowered to: let a contract; to sue or be sued by another entity or person; and WHEREAS, the primary purpose for acquiring a replacement ferry vessel will be to benefit the public and will not benefit a private entity or individual; and WHEREAS, matching funds from both the EDA grant fund and ISTEA STP fund required for this project have been applied for and will be available and committed to this project by July, 1997; and the City will have the authority to expend the funds; and WHEREAS, if the replacement ferry vessel acquisition project exceeds the state funds available, the City shall use other funds - to backfill the cost increases to complete the project; and WHEREAS, the City will comply with the California Transportation Commission's Timely Use of Funds policies. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that said Council hereby authorizes staff to apply for TCI funds for the acquisition of a replacement ferry vessel for the Alameda/Oakland ferry. BE IT FURTHER RESOLVED that said Council hereby guarantees matching funds, as hereinabove described, for said project. Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12701 APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE FOR THE MAIN STREET LINEAR PARK PROJECT AND AUTHORIZING CITY MANAGER AS AGENT WHEREAS, the Legislature of the State of California has enacted AB 471 (Chapter 106 of the Statutes of 1989), which is intended to provide $10 million annually for a period of 10 years for grant funds to local, state and federal agencies and nonprofit entities for projects to enhance and mitigate the environmental impacts of modified or new public transportation facilities; and WHEREAS, the Resources Agency has established the procedures and criteria for reviewing grant proposals and is required to submit to the California Transportation Commission a list of recommended projects from which the grant recipients will be selected; and WHEREAS, said procedures and criteria established by the Resources Agency require a resolution certifying the approval of application by the applicant's governing body before submission of said application to the State; and WHEREAS, the application contains assurances that the applicant must comply with; and WHEREAS, the applicant, if selected will enter into an agreement with the State of California to carry out the environmental enhancement and mitigation project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the City Council hereby: 1. Approves the filing of an application for the Environmental Enhancement and Mitigation Program for grant assistance for the Main Street Linear Park project. 2. Certifies that said applicant will make adequate provisions for operation and maintenance of the project. 3. Appoints William C. Norton, City Manager as agent of the City of Alameda to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project. Diane Felsch, City Clerk City of Alameda CITY OF ALAMEDA RESOLUTION NO. 12702 AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO FILE AN APPLICATION FOR FEDERAL ENHANCEMENT PROGRAM FUNDING FOR $848,500 TO IMPROVE ATLANTIC AVENUE CORRIDOR, COMMITTING THE NECESSARY LOCAL MATCH FOR THE PROJECT AND ALSO STATING THE ASSURANCE OF THE CITY OF ALAMEDA TO COMPLETE THE PROJECT WHEREAS, the City of Alameda has the authority under California Government Code and the City Charter for the exercise of certain powers to file and application for funding; and WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) (Public Law 102-240, Dec. 18, 1991) created Surface Transportation Program (23 U.S.C.S. 133); and WHEREAS, the new Federal Reauthorization may continue the Surface Transportation Program; and WHEREAS, pursuant to the ISTEA, and the regulations promulgated thereunder, eligible project sponsors wishing to receive Surface Transportation Program grants for a project shall submit an application first with the appropriate metropolitan AO transportation planning organization (MPO), for review and _s inclusions in the MPO's Transportation Improvement Program (TIP); vie and ■141110 WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco Bay region; and C) WHEREAS, the City of Alameda is an eligible project sponsor for Surface Transportation Program funds; and WHEREAS, the City of Alameda wishes to submit a grant application to MTC for funds from the Surface Transportation Program in fiscal year 1997-98 for the following project: Atlantic Avenue Corridor Improvement $848,500 WHEREAS, MTC requires, as part of the application, a resolution stating the following: 1) The commitment of necessary local matching funds (at least 20% for bicycle and pedestrian projects, and at least 11.5% for all other projects); and 2) that the City understands that the Surface Transportation Program funding is fixed at the programmed amount and, therefore, any cost increase cannot be expected to be funded with Surface Transportation Program funds; and 3) the assurance of the City to complete the project as described in the application and, if approved, as programmed in MTC's TIP. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Alameda that the City Manager or his designee, is hereby authorized to execute and file an application for funding under the Surface Transportation Program of the ISTEA in the amount of $848,500 for the Atlantic Avenue Corridor Improvement. BE IT FURTHER RESOLVED, that the City of Alameda by adopting this resolution does hereby state that: 1) The City of Alameda will provide $97,600 (11.5%) in local matching funds; and 2) The City of Alameda understands that the Surface Transportation Program funding for the project is fixed at $750,900 and that any cost increases must be funded by the City of Alameda from local matching funds, and that the City of Alameda does not expect any cost increases to be funded with Surface Transportation Program funds; and 3) The Atlantic Avenue Corridor Improvement will be built as described in this resolution and, if approved, as programmed in MTC's TIP. BE IT FURTHER RESOLVED, that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application; and BE IT FURTHER RESOLVED, that the MTC is requested to support the application for the project described in the resolution and to program the project, if approved, in MTC's TIP.
