CALLING A SPECIAL ELECTION IN THE CITY OF ALAMEDA FOR THE
PURPOSE OF SUBMITTING TO THE ELECTORS AN ORDINANCE
ENTITLED "AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
SUBSECTION 26 -1.1 THEREOF RELATING TO THE USE OF
ASSESSMENT DISTRICT PROCEEDINGS FOR CONSTRUCTION AND
IMPROVEMENT OF BUILDINGS FOR LIBRARY AND CARNEGIE
BUILDING REHABILITATION AND REUSE PURPOSES "; FIXING THE
DATE OF SAID ELECTION, THE MANNER OF HOLDING SAME, AND
PROVIDING FOR NOTICE THEREOF; CONSOLIDATING SAID SPECIAL
ELECTION WITH THE PRIMARY ELECTION OF THE STATE OF
CALIFORNIA TO BE HELD ON TUESDAY, MARCH 26, 1996; AND
PROPOSING SAID ORDINANCE
WHEREAS, the Council of the City of Alameda hereby proposes to
submit to the voters of said City an ordinance entitled "Amending
the Alameda Municipal Code by Amending Subsection 26 -1.1 Thereof
Relating to the Use of Assessment District Proceedings for
Construction and Improvement of Buildings for Library and Carnegie
Museum or Other Public Purposes" to be voted upon at the Primary
Election of the State of California to be held on March 26, 1996;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
ALAMEDA THAT:
Section 1. The Council of the City of Alameda hereby proposes
on its own motion that an ordinance be submitted to the voters of
said City at said election, to read as follows:

AMENDING SUBSECTION 26 -1.1 OF THE ALAMEDA
MUNICIPAL CODE TO PROVIDE EXPLICIT AUTHORITY
TO USE ASSESSMENT DISTRICT FINANCING FOR
LIBRARY AND CARNEGIE BUILDING REHABILITATION
AND REUSE IMPROVEMENTS
The People of the City of Alameda ordain as follows:
Section 1. Section 26 -1.1 of the Alameda Municipal Code is
amended by adding thereto the following paragraph to appear after
the current text:
For the purposes of this Chapter, the
construction or acquisition, or both, of a
building or buildings or the acquisition of
lands or easements, or both, for library and
Carnegie Building rehabilitation and reuse
purposes shall be deemed a public improvement
of a local nature. The explicit authority to
use the assessment proceedings described in
this Chapter for library and Carnegie Building
rehabilitation and reuse purposes shall not be
construed as a limitation or restriction on
the use of such proceedings for any other
public improvement of a local nature.
Section 2. This ordinance shall be in full force and
effect ten (10) days from and after the date of its
adoption.
Section 2. The City Council hereby proposes to and does
hereby on its own motion, pursuant to the authorization provided by
section 22807 of the Elections Code, submit the proposal to the
qualified electors of the City of Alameda in a special municipal
election to be consolidated with and voted upon at the March 26,
1996, statewide primary election to be held on that date.
Section 3. The proposal shall be designated on the ballot as
"Proposed Ballot Measure of the City of Alameda" and shall be set
forth as the first City of Alameda measure on the ballot if more
than one such measure is submitted, as follows:

City of Alameda
Shall an ordinance be adopted forming
a citywide assessment district to
provide funds to build a new main
library and to rehabilitate and
seismically upgrade the Carnegie
Building for use as a museum or other
public purpose through the levy of an
annual assessment that shall not
exceed $68.50 on residential properties
and a proportionate annual assessment
on non-residential properties for up
to 30 years.

Section 4. The City Council hereby requests the Alameda
County Board of Supervisors (the "Board") to consolidate the
election on the Measure with the statewide primary election to be
held on March 26, 1996.
Section 5. The Board is hereby requested to make its order
and to take such other and further proceedings as may be necessary
to effect the consolidation of said election with the statewide
primary election all in accordance with the laws of the State of
California regulating and providing for the consolidation of
elections.
Section 6. The Board is hereby authorized and empowered to
canvass the returns of the election on the Measure and to certify
the results thereof, that only one form of ballot shall be used,
and that said consolidated elections shall be held in all respects
as if there were only one election.
Section 7. The consolidation election shall be held and
conducted, election officers appointed, voting precincts
designated, candidates nominated, ballots printed, polls opened and
closed, ballots counted and returned, returns canvassed, results
declared, certificates of election issued and all other proceedings
incidental to and connected with the election shall be regulated
and done, all in accordance with the provisions of law regulating
the statewide election.
Section 8. The City Clerk is hereby authorized, instructed
and directed to provide the Alameda County Registrar of Voters with
all pertinent information and material as required.
Section 9. The City Clerk shall publish, or shall provide for
the publication of, any notices as required by Division 14 of the
Elections Code and in particular section 22835.
Section 10. Upon completion of the election and canvassing of
the ballots and the results declared, the City Clerk shall certify
the results of the election in the records of proceedings of the
City Council at the next regular meeting.
Section 11. The City Clerk is hereby directed to file
immediately a certified copy of this resolution with the Alameda
County Board of Supervisors and with the Alameda County Clerk.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 19th
day of December , 1995, by the following vote to wit:

Mannix and President Appezzato - 5.
NOES: None.

ABSENTENTIONS: None.
