TRANSFERRING OWNERSHIP FROM THE COUNTY OF ALAMEDA TO THE CITY
OF ALAMEDA AND ASSURING VETERANS CONTINUED ACCESS TO
AND USE OF THE ALAMEDA VETERANS' MEMORIAL BUILDING AS
REQUIRED BY THE CALIFORNIA MILITARY AND VETERANS' CODE
WHEREAS, the City of Alameda has requested that the County of
Alameda transfer ownership of the Alameda Veterans' Memorial
Building, located at 2203 Central Avenue, City of Alameda, to the
City of Alameda; and
WHEREAS, such transfer of ownership is authorized by military
and Veterans Code section 1262(h); and
WHEREAS, the City of Alameda owns the land on which the
Alameda Veteran's Memorial Building is located; and
WHEREAS, the lease of said land by the City of Alameda to the
County of Alameda has expired; and
WHEREAS, the City of Alameda assumes the obligation of the
County of Alameda according to the State Veterans' Code to provide
a meeting place for veterans in the City of Alameda; and
WHEREAS, the City of Alameda will provide the necessary
maintenance and upkeep of the Alameda Veterans' Memorial Building
and be advised of the need for such maintenance and upkeep by a to
be formed Alameda Veterans' Memorial Building Advisory Commission
reporting to the Public Works Director; and
WHEREAS, said Advisory Commission will supersede the existing
Alameda County Alameda Veterans' Memorial Building Commission; and
WHEREAS, the City of Alameda intends to utilize the Veterans'
Memorial Building for a variety of uses, including but not limited
to the housing of City of Alameda and /or County of Alameda
departmental staff and the holding of meetings for various City of
Alameda Boards and Commissions; and
WHEREAS, the City of Alameda acknowledges the extreme bravery
and valor demonstrated by veterans in the service of their country,
and acknowledges the great debt owed to veterans by the City of
Alameda and the Nation at large; and
WHEREAS, the use of the Veterans' Memorial Building by the
City of Alameda will not unduly interfere with the continued access
to and reasonable use of the building by veterans.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Alameda hereby authorizes the City Manager to request
Alameda County to transfer the Veterans's Memorial Building to the
City of Alameda.
BE IT FURTHER RESOLVED that the City Council of the City of
Alameda hereby accepts the Veteran's Memorial Building upon
transfer of the facility from the County of Alameda and authorizes
the City Manager to execute all documents necessary to effect the
transfer.
BE IT FURTHER RESOLVED that the City Council agrees and
assures that upon the transfer of the Veterans' Memorial Building
to the City of Alameda, all rights granted to veterans under the
California Military and Veterans' Code for the continued access to
and reasonable use of the Alameda Veterans' Memorial Building shall
be preserved.
BE IT FURTHER RESOLVED that nothing contained in this
Resolution shall be changed or modified absent a noticed public
hearing before the City Council.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 6th
d`ay of February , 1996, by the following vote to wit:
AYES: Councilmembers Arnerich, DeWitt, Lucas,
Mannix and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSENTENTIONS: None.
